At the time I was couch surfing and living out of my car, so the company was built out of survival. I bartered my first fifteen social media marketing contracts, and MK-Way was born from those." "Through COVID we helped small businesses across Ontario get online, because suddenly everybody needed a website. Today MK-Way is a multifaceted company of employees and contractors working remotely from all over the world, with a culture built on kindness, empathy and empowerment. People who have never met in person thrive together here, whether the work is branding, websites or paid ads." "In 2026 we moved into automations, because owners are drowning in manual processes they can't afford to hand to a hire. An AI automation built into the website answers a lead in 30 seconds, gets a proposal out in 45 minutes instead of five hours, and turns two hours of Sunday admin into two minutes at a Claude Code command line." ### Anastasia Tsoupa Founding Chief Creative Officer "I was working at Pink Woman in Greece and knew I could do more, and leave a legacy. When I joined Mike's team at Mike Kwal Digital we rebranded it to MK-Way, because I saw something bigger, more spatial, galactic. As the brand grew I got to build the kind of company I would want to work for." "Something Mike said has stayed with me: everyone here is an owner, not a renter. Renters don't care for the place. Here everyone works with mutual respect, for each other, for our clients and for the place we work, with kindness and empathy. My work is respected, and every day I'm contributing to the businesses we work with." "The strategies I've honed are being executed in companies that have grown into multimillion-dollar businesses, and in enterprise companies far bigger than that. I can see the full circle: the creative strategies and designs we build at MK-Way helping other human beings on their own journey." Know You'll never be left in the dark. Core values ## How we work. - Websites first The site is the centre of the business. Nothing gets wired in until the centre is right. - Tested on us before you Every automation runs inside MK-Way before a client ever sees it. If it doesn't save us hours, it doesn't ship. - Plain words If a step can't be explained to an owner without jargon, it isn't finished. - Gates, not guesses Blueprint, design, ship. Nothing moves to the next stage without a yes, and nothing goes live without a backup. Enter Mission Control ## Why do people buy from us? Our culture. Why do people buy from us? Our culture. Happy leaders, innovators and CEOs like to buy from happy people. Lift a visor to meet the human behind it. The AI crew ## Eleven AI specialists. One job each. Built here, broken here and fixed here before a client relies on them. They don't decide and they don't talk to you. They execute, at 9 pm, without complaining. AI-Website Team ### Site Architect Maps the pages, the URLs and the navigation before a pixel moves. ### UX Strategist Turns the blueprint into page briefs, flows and forms that convert. ### Copywriter Writes every headline and button in plain words. No AI tells. ### UI Designer Owns the design system and builds the pages around the copy. ### Motion Designer Adds the motion that earns its place, and cuts the motion that doesn't. ### Site Doctor Audits, measures and signs the Ship Report. Nothing ships without it. ### Publisher Deploys to WordPress, Webflow, Shopify or Cloudflare, with a rollback ready. AI-SMM Team ### Pulse Agent Finds what's worth filming today, before the desk opens. ### Scriptwriter Drafts scripts and hooks that sound like the person on camera. ### Video Editor Cuts the master, the verticals, the captions and the thumbnail. AI-BDR Finds the right contacts, writes the first line, sends from our own mailbox. Since 2020 ## Our story. MK-Way started in the middle of COVID and has moved every time the work changed shape. The website was always the centre. What we wire around it is what changed. - 2020 A shoebox in the sky MK-Way started during COVID in a small condo high over Toronto. One desk, a window, the first clients, and a lot of video calls. - Then 80 Atlantic Avenue The first real office, at 80 Atlantic Avenue in Toronto. The crew grew, the client list grew, and the work settled into websites, brands and video. - 2026 London, Ontario We moved the office to London, Ontario, and kept the crew 100% remote. The address changed. The way we work with clients didn't. - 2026 Into AI automations The same year we moved into AI automations. The website stayed the centre, and the jobs around it got wired in: sales, admin, marketing, run by agents we build for you. We build them, you run them. AI automations # If you can teach someone, you can also teach AI. Why you're here ## Three hours every Sunday on work a machine should do. Somebody in your business spends their Sunday on manual work: the quotes, the follow-ups, the invoices, the posts. Work that could be built once, for a fixed price, and then done by an autonomous agent every week after that. We take that job off their desk, not the person. They get the real one back. Your site, your tools and your accounts stay where they are. We wire the agent in around them. 3 h a week, gone Once paid, at a fixed price agent to start with Where we are in the AI era ## Three buckets. We build in the third. The word AI covers three very different things. Knowing which one you're buying is most of the decision. - Era one Chatbots You type, it answers. Useful for a FAQ and a first draft. It never touches your tools. Most companies stopped here. - Era two Automations Tools like n8n and Make move data when something happens: a form lands, a row gets written, an email goes out. Fixed rails, no judgment. Great until step four breaks at 2 am. - Era three Agentic AI An agent has a job, your rules, and the authority to act. When a step breaks, it reads the error, fixes it, and tells you what it did. This is what we build. Now showing ## What problem does an AI employee solve? Real jobs, not demos. Each channel is one agent we build. Pick the one that eats your evenings. Guide On air CH 01 · Video editing agent ### Edits all your social media content. The raw recording goes in. The posts come out. The problem Filming is the easy part. Cutting, captioning, resizing for every platform and posting on a rhythm is the three hours nobody has, so the footage sits on a drive. The AI employee Takes the recording, cuts the master and the verticals, writes the captions and the hooks, builds the thumbnail and queues the posts. You approve, it publishes. Fifteen minutes a video. On air CH 02 · Voice agent ### Lead agent callback in 30 seconds. The quote form lands at 7 pm. The phone rings at 7:00:30. An arborist gets a quote request at dinner time. By the time anyone calls back the next morning, the homeowner has booked someone else. Calls the lead back within thirty seconds, confirms the address, the tree and the access, and books the site visit into the calendar. The owner hears about it at breakfast. On air CH 03 · Sales agent ### Quotes that follow themselves up. Day three, day seven, then it stops the moment they reply. Quotes go out and nobody chases them. The ones that would have closed with one nudge quietly die in an inbox. Sends the nudge in your words on day three and day seven, logs the reply in the pipeline, and stops the second someone answers. On air CH 04 · Finance agent ### Invoices that chase themselves. Reminders in your voice, on your schedule, with the link. Overdue invoices sit because chasing money feels awkward and takes an evening you don't have. Sends the reminder with the payment link, escalates the tone on the schedule you set, and hands you a weekly list of who paid. On air CH 05 · Admin agent ### An inbox that sorts itself. Every email read, sorted and drafted. You tap approve. The inbox is a full-time job: quotes, bookings, supplier questions and the one email that actually needs you, buried under the rest. Reads every message, drafts the reply for the routine ones, builds the onboarding kit when a client signs, and flags the ones only you can answer. On air CH 06 · Sales proposals ### Proposals from a voice note. Two minutes after the call. A scoped PDF, priced from your rate card. The discovery call went well and the proposal still takes a week, because writing it is the job nobody wants after 6 pm. Turns your two-minute voice note into a scoped proposal with pricing from your rate card, as a PDF, ready to send the same afternoon. On air CH 07 · Morning AI pulse ### A morning pulse at 7. What your market said overnight, and what's worth filming today. Content stalls because deciding what to say takes longer than saying it. Every morning, a short brief: what your market talked about overnight, the three best angles, and a draft hook for each. You pick one and press record. On air CH 08 · GTM enrichment ### Prospects found, enriched, written to. The AI BDR. A day of prospecting, done in an hour. Prospecting is eight hours of list-building, researching and writing first lines, so it only happens when sales are already slow. Finds companies that look like your best customers, finds the decision maker, enriches the record, writes the first line in your voice and sends it from your own mailbox. Replies get a call back within a minute. On air CH 09 · CRM agent ### Meeting notes into the CRM. The call ends. The deal notes, next steps and tasks are already there. Nobody types up the call, so the CRM is a graveyard of half-filled deals and the follow-up email never gets written. Turns the transcript into deal notes, next steps and tasks in your pipeline, and drafts the follow-up email for you to send. On air CH 10 · Reviews agent ### Reviews asked for on time. A week after the job closes. Nobody has to remember. Happy customers would leave a review if someone asked at the right moment. Nobody does. Sends a short thank-you and the review link a week after the job closes, and keeps the running tally. On air CH 11 · Shopify agent ### A store that keeps itself tidy. Descriptions, tags, alt text, stock and a 3D model, by themselves. New products arrive faster than anyone can write them up, and the supplier sheet never matches the store. Writes the descriptions, tags and alt text, syncs prices and stock from the supplier sheet, fixes the out-of-stock pages, and adds a 3D model through VERA. On air CH 12 · And more ### Bring us the job. If you can teach someone to do it, we can build the agent that does it. Every business has one job that eats a person. Yours is probably not on this list. Tell us what it is in the form at the bottom of the page. You get a one-page proposal: which agent we would build first, what it does, what it costs, and what it saves. The AI BDR, drawn ## From a list to a booked call. This is the whole funnel. No human touches it until the call is booked. The person who replies gets a call within a minute, the one who doesn't gets two polite nudges, and every booked call lands in your pipeline tagged as a marketing-qualified lead. ai-bdr/funnel.txt claude code · ai-bdr Four AI teams ## We build them. You run them. We maintain them. These run inside MK-Way every day, and they are the same four we build for clients, in your accounts, in your name. The numbers are ours. Prospecting ### AI BDR A day of prospecting, done in an hour. Lives in Your mailbox, GoHighLevel and the enrichment tools, in your accounts. Replaces The list-building, research and first lines a person spends a day on. Asks you You approve the list and the first line before anything is sent. Social content ### AI SMM team A content team's output without the content team. Your recordings, your channels and a morning brief in your inbox. A roughly $15,000-a-month content team: strategist, editor, designer, scheduler. You approve, it publishes. Nothing goes out without your yes. Websites ### AI website team A website build in four hours instead of forty days. Your repo and your hosting. This site is one of its builds. Seven roles: architect, UX, copy, design, motion, QA and publishing. A human approves every gate: blueprint, design, ship. Shopify ### AI Shopify team A Shopify build in three days instead of three months. Your store, through the Shopify CLI, plus VERA and Orbit3D for the 3D. Theme, apps and catalogue work done by hand, click by click. Nothing ships to the live store without your yes. Who it's for ## Two kinds of business. The same Sunday. ### It's Sunday. You're doing the quotes. One person does sales, admin and marketing between jobs, and the admin happens at night. We take the three jobs that eat the evenings first. What we build first - The callback - The follow-up - The invoice ### Your best people are retyping things between systems. There's a team, and the handoffs between them are where the hours go: lead to rep, deal to delivery, delivery to invoice. We wire the handoffs and give people back the half of the job they were hired for. - AI BDR with enrichment - Meeting notes to CRM - Proposals from the rate card Anatomy of an agent ## Every agent we ship has the same four parts. Built with Claude Code, the same tool we run MK-Way on. It runs in your accounts, in your name. You own it; we maintain it. - 01 Playbook The written rules it works by: its job, the calls it makes, what it never does. You can read all of it. - 02 Second brain Everything it is allowed to know: your prices, your wording, your clients, your processes. Nothing else. - 03 Tools What it may touch and what stays locked. Anything that moves money or leaves the building waits for your yes. - 04 Log Every step it takes, written down, and a weekly report. When a step breaks, it fixes it and tells you. Talk to Build, skeleton draft Storyboard Talk to Build Product film Our step-by-step guide ## The mission protocol. Seven steps from concept to cinematic delivery. Every step, every deliverable, so you know when we need your creative input and when to sit back. Step 01 of 7 ### Concept and strategic purpose Every great video starts with a why. Before a frame is rendered, we define what action the video must trigger, who it's speaking to, and the emotional arc that gets them there. Client action A brief call to align on goals, audience, platform and tone. We do the rest. - Strategic objective - Target audience profiled - Platform and format Social, ad, TV spot, film. - Tone and emotional arc Step 02 of 7 ### Scenario development With the strategy locked, our writers build the scenario: a detailed narrative blueprint that maps every moment of the video. This is where the story lives before it becomes visual. Review round You review the written scenario before we move to visuals. - Scene-by-scene narrative - Dialogue and voice direction - Character roles If the story has them. - Pacing and timing Step 03 of 7 ### Storyboard The scenario becomes a visual storyboard: frame-by-frame panels showing camera angles, composition, transitions and tone. The architectural blueprint of the final film. Client decision Approve the storyboard before AI generation begins. Changes are easiest here. - Shot-by-shot panels - Camera movement and framing - Colour palette and lighting mood - Transition and pacing notes Step 04 of 7 ### AI scene generation Our directors use a curated stack of AI tools to generate the scenes. Every frame is directed by human judgment, not left to chance. We iterate fast and keep the strongest takes. - Image and video generation Sora, Runway, Kling, Midjourney. - Scene-by-scene iteration - Visual consistency enforced - Raw scene library assembled Step 05 of 7 ### Avatars and characters Where the story calls for human or animated characters, we develop custom AI avatars: consistent across every scene, fully controllable, on brand. Note Only when the scenario needs characters or presenters. - Avatar design and training - Consistency across scenes - Lip-sync and expression control - Brand-aligned appearance Step 06 of 7 ### Voice overs Audio is half the experience. Where voice is needed we produce AI voice overs, scripted, timed and matched to the cut, or bring in human voice talent when the project demands it. Note Only when the scenario has narration, dialogue or a presenter. - Script timing and pacing - Voice generation and selection - Tone and delivery direction - Sync to the cut Step 07 of 7 ### Final cinematic assembly Scenes, characters, voice, music, motion graphics and sound design come together in After Effects. A 69-page brand strategy we delivered this year, with the client's name and logo left out. This is the process. Take it. - Chapter 1 Market research Market size, service trends, the gaps nobody is filling, and what people search for, by region and by month. - Chapter 2 Buyer personas Three to four people, named, with what they fear, what they want, and the one line that would make them call. - Chapter 3 Audience research Who they are, where they spend time online, which sites they trust, and what they say when nobody from a brand is listening. - Chapter 4 Language analysis The words your customers actually use, the words they hate, and the vocabulary a brand should adopt to sound like it gets them. - Chapter 5 Competitive research Every competitor mapped by archetype, message, reviews and feature set, so we find the white space instead of guessing it. - Chapter 6 Strategic takeaways Three or four positioning opportunities the research points to, each with the proof behind it. - Chapter 7 Brand framework Positioning, the meaning in the name, and the brand model: differentiation, relevance, esteem, knowledge. - Chapter 8 Brand story The promise, the one-ness statement, the positioning statement, and the unique selling points written out in full. - Chapter 9 Brand language and messaging Messaging pillars, slogan-style lines, narrative lines and the primary direction. Words a copywriter can build from. Free, the whole process ### Want the framework as a document? It's yours. The chapter list, what goes in each one, and the questions we ask to fill it. Sales, operations and marketing automations around your site, so leads get answered in minutes, not hours. The Business OS # Your website, with the busywork wired around it. The Business OS is MK-Way's done-for-you package. A website at the centre of your business, with sales, operations and marketing automations built around it, so the repetitive work happens without you. Payload ## One thing you buy, four jobs it does. The website is the core. Sales, operations and marketing are wired around it, and each one is a small agent with one job and a private second brain that knows your business. ### The website A site built around the customers you want, on a fast, simple stack you own. It's the front door and the hub. Every automation plugs into it. ### Sales Enquiries land in one place. Quotes go out the same day, with your pricing and your wording. Follow-ups send on a schedule until someone answers, then stop. ### Operations New clients get their welcome, forms and first steps without you writing them. Overdue invoices get a polite reminder on time. Handover notes build themselves from what your system already knows. ### Marketing Posts, short videos and email go out on a rhythm you set once. You approve, it publishes. Your brand stays consistent because the system knows your brand. How an automation runs ## Your tools talk to one brain. The work comes out the other side. Nothing to learn. Your website, your boards and your inbox already talk to it. Each job is one small agent with one task and a private second brain that knows your prices, your wording and your clients. What talks to it One small agent per job. Tested on MK-Way first. What comes out Flight plan ## How does it work? Four steps, one yes at each. - 01 Map the manual work We sit with you and list every job you do by hand each week. Quotes, chasing, onboarding, posting. We put a rough hours figure next to each one. - 02 Build the site We design and build the website around your customers and your offer. You see it and approve it. Nothing goes live without your yes. - 03 Wire the automations We connect the jobs from step one to the site, starting with the one that eats the most hours. Each one is tested on real work before you rely on it. - 04 Hand over and keep improving You get plain instructions and a walkthrough. We stay on to fix what breaks and add the next automation when you're ready. To confirm: ongoing support / retainer terms Who it's for ## Built for owners who would rather run the business. ### The established owner You have a brand, maybe a store or two, and a business doing somewhere between $12,000 and $20,000 a month. Your week is full of things you know a computer should be doing. You don't want to learn a new tool. You want the work to stop landing on you. ### The builder You're building something of your own and you want it to look like a real company from day one. You need the brand, the site and the systems in place before the first customer arrives, without a payroll to run them. To be clear ## What it is not. - Not a coding course. We build it and run it. You use it. - Not a template. Your site is built around your customers and your offer, and the automations follow your actual process. - Not a chatbot bolted on. The work happens behind the scenes, in the tools you already use. Questions & Answers ## Questions owners ask before they buy. Make contact ## Get a free Business O/S plan. Pay as you go, no contracts, and more value every time. Growth Credits # The 20% extra. Growth Credits. 20% of every project value, set aside no expiry while we work together extra charge, ever 100% yours, no strings The concept ## What are Growth Credits? On every project we set aside a 20% strategic reserve. Not as extra billing. As a commitment built into how we work. That reserve is your Growth Credit balance. The team deploys it proactively during the mission, which turns every project into a self-improving growth engine that gets more valuable over time. Think of it as A slightly neurotic co-pilot who never stops scanning for problems, and has the authority to fix them on the spot, without a change order. The process ## How it works. We anticipate. We don't wait for a request. - 01 Scan Proactive gap detection During every mission the team keeps scanning for expensive mistakes and hidden gaps: a headline that isn't converting, a mobile button that's hard to hit, a call to action that's buried. - 02 Deploy Instant credit deployment We don't report it and wait for an approval. We deploy your Growth Credits to fix it on the spot. No change orders, no extra invoices, no waiting for a call. - 03 Compound Your project grows itself Every fix, every optimisation, every proactive improvement adds up. Your project doesn't just launch. It keeps getting better as long as we're in orbit together. The philosophy ## Why we do this. Most agencies treat your budget as their profit. They do the bare minimum and hope you don't notice the gaps. We treat your budget as a mission. We don't just do what's on the invoice. We do what's necessary, because we care about the long-term equity of your business, not just the deliverable on the receipt. > "We don't hand you a product and disappear. We stay in orbit and keep fighting for your results, because your win is our reputation. " The MK-Way pilot credo A supercharged toolkit ## Examples of proactive value. This isn't a menu of options. It's a toolkit the team uses to supercharge your results without you ever having to ask. ### Extra creative directions Instead of limiting you to three concepts, we might explore five, or eleven, if the mission needs it. We explore until the identity is right. ### Additional page scope Need a landing page or a service page that wasn't scoped? We design and build it with your credits. No change order. ### Generative AI visuals Missing the right photography? We produce dozens of bespoke, fully branded images for your exact world. ### Full content strategy We don't just design around your text. We restructure, rewrite and plan the content so the page sells. ### Custom brand assets Patterns, illustrations, packaging mockups, social templates. The premium assets you didn't know you needed. ### Post-launch fixes The first weeks live always show something. Credits cover it, so you're never choosing between a fix and an invoice. The rules ## Three commitments. No fine print. No expiry As long as we're in orbit together, your credits stay active. No use-it-or-lose-it deadlines. No pressure to invent tasks to spend them. Team-led allocation You don't apply for credits or pick from a menu. The team finds the highest-impact gaps and fills them, so the mission succeeds, not just the invoice. Full ownership Everything built with these credits is 100% yours. No gatekeeping, no extra licensing fees, no "you'll lose it if you leave". Ever. See your value ## The Growth Credits calculator. Slide to see how much proactive value you unlock on your project. Growth Credits are proactive strategy and production value deployed during your mission, not a cash rebate. You invest $10,000 $2,000 Total value $12,000 Make contact ## Ready to unlock your credits? Tell us about the project. Every MK-Way project comes with 20% in Growth Credits, deployed by the team where it moves the needle most. - 1 You send the note. - 2 We read it, look at what you've got, and reply with a plan or a question. - 3 If it's a fit, you get a scope and a price. If it isn't, we'll tell you who to call instead. --- ## The New Story Fund: 3% of every project funds art programs | MK-Way URL: https://mk-way.com/new-story-fund/ Summary: The New Story Fund: 3% of every MK-Way project funds art therapy for trauma survivors and neurodiverse youth. The full web design roadmap: the exact deliverables at every stage and a clear breakdown of your role, so you know when we need you and when you can stay in cruise control. Step 01 of 10 ### Onboarding and access We kick off by making sure the technical foundations are ready. Our project manager guides you through gathering everything we need. Client action You provide hosting and domain details, the intake questionnaire, and secure access to logins and assets. - Hosting and domain We discuss your options and guide you on setup. - Intake questionnaire Your vision, goals and requirements. - Access provision Secure sharing of the relevant logins and assets. Step 02 of 10 ### Strategy call We meet to align on the website's goals, audience and functionality. We discuss your products and services, identify the key features, and set the creative direction. Note This step can be skipped if we've already designed your brand strategy. You stay in cruise control for this one. We handle the flight. Step 03 of 10 ### Architecture and strategy We blueprint the entire website before building a single screen. - Sitemap A complete outline of every page and subpage. - Content strategy What each page is for and what it has to say. - Information architecture The order and hierarchy of the content. - Conversion strategy Where every call to action goes, and why. Step 04 of 10 ### Copywriting and wireframing Content comes first. We present it in a wireframe so you can react to the words and the structure before design begins. Review round You review the copy inside the wireframe and we apply your revisions. - Copywriting If included, we write the copy for the entire website. - Wireframe presentation Copy within a structural layout for review. - Revisions We apply the revisions to the copy. Step 05 of 10 ### Creative direction Before designing the full site, we establish the visual language. We develop the first three sections of the homepage in up to three different styles. Client decision You review the options and pick the direction that fits your vision. Step 06 of 10 ### Full UI design We expand the approved direction across the entire website: every page, every section, every interaction state. High-fidelity, pixel-precise, unmistakably yours. Review round Round one: you review the full design and give consolidated feedback. Step 07 of 10 ### Refinement and approval We apply your round-one revisions and design the full mobile view. Final approval Round two: review the revisions and the mobile view, then give the green light for development. Signed off. Step 08 of 10 ### Development Our developers bring the approved design to life: pixel-perfect, fast, responsive, and built on the platform that fits your business. The build Static designs become a fully functional, interactive website on a staging link. Step 09 of 10 ### Final polish and launch approval We apply the final polish from your staging review and run the technical QA checklist across devices and browsers. Final approval Round three: feedback through our comment-based review tool, then sign-off on the fully functional site. Step 10 of 10 ### Migration and launch We cross the finish line. - Technical QA Final quality checklist across all devices and browsers. - Migration and launch We move the site to your live domain, connect SSL, and launch. - Growth Credits 20% of the project value stays in reserve for the fixes the first weeks show. 1 / 10 Platform agnostic ## We fit your world. Not ours. Traditional web shops push the platform they know. We choose the one that fits your business model, your team and your growth plan, then build on it. Our recommendation is always unbiased. We tell you which platform gives you the most control, the lowest lock-in and the best performance for your case, even if it's the one we find hardest to build on. Questions & Answers ## Frequently asked questions. Free, no strings ## Get a free website proposal. Tell us what you sell and what the site has to do. They approached MK-Way to solve a dual-business challenge: one brand had to seamlessly represent both an in-person creative studio and an online retail experience. Their vision was to promote happiness, encourage disconnection from technology, and foster a community for families and friends to bond over creativity. ## One Brand. Two Worlds. The central challenge was reconciling the dual nature of their business — a warm, vibrant in-person studio on one hand, and a polished online store on the other. Both needed to feel like the same brand without one overshadowing the other. The solution lay in colour. A bold, energetic palette could bridge the joy of the studio experience with the confidence of modern e-commerce — creating a brand that felt equally at home on a tote bag and a Shopify storefront. ## Built Around the Creative Spirit. We began with deep brand excavation: in-depth interviews with the founders, buyer persona development, competitive analysis, and brand story crafting. This process crystallised the brand's mission — to give people a creative outlet, connect the community, and spread happiness through art. We developed moodboards capturing a playful, energetic aesthetic — vibrant colours evoking joy and inspiration, modern fonts with a touch of playfulness, and imagery rooted in creative community. This laid the visual foundation for everything that followed. We sketched out different logo ideas — playing with custom lettering, heart symbols, and creative strokes to capture the brand's artistic vibe. The final logo features the letter "V" in "Love" replaced by a heart symbol, with a paintbrush stroke underneath representing the artistic nature of the business. ## A Visual World Bursting with Life. We built a bold, multi-colour palette anchored by Sea Blue and Hot Magenta — colours that evoke creativity, energy, and joy. Black adds contrast, hinting at the beautiful messiness of the creative process. Each colour was designed to pair harmoniously, giving the team confidence in every application. We selected a playful yet versatile type system. Primary fonts carry the brand's expressive personality — bold and distinctive. Secondary typography adds depth and readability across captions, body copy, and UI elements. Inspired by the moodboards, we created hand-drawn graphic elements and a series of digital stickers using the brand symbol and slogans. These stickers work online and in print — on packaging, tote bags, and event materials — unifying the studio and online store experience. ## The Brand, In the Wild. From outdoor billboards and signage to tote bags and merchandise, we brought the brand to life across every touchpoint — creating a consistent, joyful presence that works as powerfully in the street as it does online. ## E-Commerce That Feels Like Art. We implemented a user-centric design philosophy — weaving the new brand identity and AI-generated imagery into a responsive, modern Shopify storefront. Every layout decision, typography choice, and product display reflects the brand ethos and creates a seamless, engaging shopping experience. To support wholesale operations, we integrated the "Wholesale Gorilla" Shopify app — streamlining the B2B process with tailored pricing and discounts for wholesale customers, expanding the brand's commercial reach beyond the studio. ## You Might Also Like These. ## READY FOR LIFT OFF? Be Brilliant’s website wasn’t converting visitors into clients, with issues in branding, messaging, and site structure. We redefined their brand and redesigned the website to reflect their transformative approach based on Gattegno’s "Subordination of Teaching to Learning" method. Capture the unique essence of Be Brilliant’s approach and set them apart from competitors. Competitors use similar terms ("self-learning," "confidence") with different meanings. Through research, we identified how Be Brilliant’s interpretation is more authentic and impactful. We identified specific pain points for Be Brilliant’s target audience, refining messaging to resonate with parents seeking impactful learning experiences. We crafted six core benefits and seven versatile taglines, capturing Be Brilliant’s essence. The “Aha!” Moment: A transformative learning moment where children experience a breakthrough in understanding. Emphasizes confidence-building, curiosity, and a lifelong love of learning. We established the BBT Guarantee for measurable learning outcomes, enhancing trust, and illustrated how Be Brilliant’s values differ from competitors via an engaging comparison table. Inspired by the Gattegno rods, the logo symbolizes hands-on, dynamic learning. The spark element (star + exclamation point) represents brilliance and discovery. A deep blue palette instills trust, while a bright yellow brings energy and excitement. Custom AI images reflect Be Brilliant’s unique philosophy, providing a fresh, memorable look that avoids the limitations of stock photos. Designed core visuals around the “Aha!” themes (“I Can Do It!”, “I Got It!”), creating a cohesive ecosystem across digital and physical spaces. Developed a clear, strategic content flow to highlight Be Brilliant’s values, making it easy for parents to understand their unique approach. Crafted a sleek, impactful 5-page website layout that showcases Be Brilliant’s story, focusing on high-quality, personalized education that inspires. ## Before & After MK-Way. ## You Might Also Like These. ## READY FOR LIFT OFF? Believe is a non-profit film production company that creates impactful family-friendly films, using 100% of its profits to support charitable causes through perpetual donations. Believe is a unique platform that bridges the worlds of film production and charitable giving. With a ground-breaking business model, Believe uses the power of cinematic storytelling to drive social impact by turning audience engagement into real donations for charitable causes. Our mission was to craft a brand and digital experience that seamlessly communicates this dual purpose. ## Cinema & Compassion. The main challenge was to create a visual identity that balanced the worlds of film production and donations. The brand needed to convey professionalism and cinematic quality to reflect the high production standards of their films, while also feeling warm, inspiring, and human to connect emotionally with audiences. Another challenge was to clearly communicate Believe's unique donation model—showing how small contributions can create monumental impact—and to reflect this concept through visual design, brand messaging, and user experience. ## Built from the Ground Up. Brand Excavation & Research: Through in-depth interviews with the owner, competitive analysis, market and audience research, we developed detailed buyer personas that enabled us to clearly define Believe's unique selling points and identify the core emotional triggers that drive audience engagement. Unique Value Proposition & Messaging: We defined Believe's unique value proposition and developed clear, impactful messaging. One of the key marketing messages we introduced was the powerful "$1 = $1,000" donation model, which effectively conveys the disproportionate impact of even the smallest contributions. Brand Prism & Brand Identity: We built a comprehensive brand prism to define the brand's personality, culture, and tone of voice. This exercise helped to refine the messaging across all touchpoints and served as a reference for the creative direction of the visual identity. Slogan Development: We developed the main slogan along with supporting secondary taglines that reinforce Believe's mission, used consistently across the website, marketing materials, and digital content. ## A Logo That Projects Hope. Look & Feel: We crafted a moodboard that reflected the dual essence of cinematic production and warm human connection — drawing from film production, cinematic nostalgia, and charitable giving. Logo & Visual Identity: We created a versatile logo that combines the letter "B" with the shape of a projector — a strong, recognizable brand symbol that reflects Believe's mission to project hope and action through storytelling. The fonts and color palette reinforce the cinematic feel while remaining warm and inviting. Visual Ecosystem: We designed a cohesive visual system that included logo-based patterns, icons and illustrations to ensure brand consistency across every touchpoint. Logo Character: We created a brand character based on the geometric design of the letter "B" — a playful yet symbolic brand asset used in animations, promotional materials, and interactive web elements. Comprehensive Brand Applications: We created visual materials for different brand touchpoints, including posters, digital ads, social media content, merchandise mockups, and other collateral to establish a strong and consistent brand presence. ## 100% Unique. 100% Believe. We used AI to create custom visuals that are 100% unique to Believe. These images are fully branded and visually tell Believe's story, ensuring a distinct and memorable brand presence. ## Five Pages. One Mission. We developed a streamlined information architecture for the website, ensuring that visitors could easily explore Believe's mission, learn how the model works, and understand how to contribute. Key pages were prioritized for user flow and clarity. We designed a sleek, impactful 5-page website that tells Believe's story in a way that connects emotionally and drives action. We wrote conversion-optimized copy using simple but powerful language to inspire visitors and create a lasting impact. Recognizing that the "story" is core to Believe's mission, we made storytelling a key part of the user experience. Each user journey was mapped to ensure that visitors felt connected to the brand's mission, inspired to act, and guided seamlessly from the homepage to the donation process. We created a custom website that balances the worlds of film production and donations, offering an elegant, modern design that highlights both equally. Every design decision—from layout to animations—was made with the intention of merging these two worlds into one cohesive experience. ## The Transformation. ## You Might Also Like These. ## READY FOR LIFT OFF? When Tammy, the creative mind behind the hit movie Dagmar, approached us, she came with a unique and exciting vision. The project was born from a pivotal, magical scene in her film where Dagmar, the beloved dragon, sheds his iridescent scales—the "Dragon Dust." Her goal was to extend this cinematic moment into a tangible world of children's products and merchandise. This wasn't a request to simply create movie merch; it was a challenge to build a genuine, standalone brand that could capture the film's magic and thrive on its own. ## Capturing Cinematic Magic. Our central challenge was one of translation: how to distill the essence of a visual world—the movie Dagmar—into a new, distinct brand identity. The look and feel were already established by the film's aesthetic. Our task was to create a brand ecosystem that felt authentic to its origin yet was strong enough to stand on its own across the diverse applications Tammy envisioned. The critical balancing act was to create a clear link to Dagmar without making the brand entirely dependent on the film. We needed an identity that could evoke the wonder of the dragon without literally showing him in every instance. The brand had to be sophisticated enough for a multi-category launch but playful enough to connect instantly with its young audience. ## A Brand With Its Own Tale to Tell. We developed a comprehensive brand identity system designed for flexibility, recognition, and delight. Our solution was broken down into three core pillars: a strategic logo design, a versatile color palette, and a clear vision for application. Our creative exploration began with the heart of the story: Dagmar himself. We knew a direct visual reference was necessary, but it had to be executed with subtlety and cleverness. A full dragon would have anchored the brand too heavily as "movie merchandise," limiting its potential to grow independently. Our solution was more elegant and ownable: we crafted a playful, rounded, and friendly custom wordmark for "Dragon Dust" and seamlessly integrated Dagmar's iconic tail at the very end of the name. It creates a memorable brand asset, maintains brand independence, and hints at the origin story. The "Dragon Dust" itself was our direct inspiration for the color palette. To capture the shimmering, magical quality of Dagmar's scales, we didn't choose static colors. Instead, we developed two distinct, iridescent gradients. This choice was both aesthetic and strategic. The vibrant, shifting colors immediately communicate a sense of magic and play. More importantly, the two distinct gradients function as a built-in differentiation system for diverse product lines. ## A World of Playful Applications. The strength of the identity system was proven in its application. We developed a series of mockups to showcase how the playful and delightful character of the Dragon Dust brand would come to life. By applying the logo and iridescent palettes to products Tammy envisioned, such as sets of kids' pajamas and a branded race car, we demonstrated the system's versatility. On pajamas, the logo’s tail could become a playful detail wrapping around a sleeve. On a toy car, the iridescent gradient could mimic a high-end, magical paint finish. ## You Might Also Like These. ## READY FOR LIFT OFF? Tell us what's in the way, or get a free look at your website. Dragonfly Energy Solutions specializes in developing revolutionary green energy storage solutions. The client approached us with a vision for an elevated website that would better reflect their innovative business plans and brand identity. Recognizing that their current website no longer aligned with their aspirations, they sought our expertise to realize this vision. Our primary challenge was to craft a strategic direction that captured the innovative essence of Dragonfly Energy Solutions while ensuring the website remained informative, user-friendly, and not overwhelming. We aimed to position Dragonfly Energy as an industry leader by highlighting their unique selling points (USPs) and utilizing AI generative graphics and animation. We identified the lack of an impactful above-the-fold section on their current website. Understanding that first impressions are made in the first 0.05 seconds, we focused on developing a compelling above-the-fold strategy using conceptual video integration, enhanced value propositions, and strategic CTAs. Leveraging information from their old website, we introduced an elevated information architecture designed to provide visitors with a seamless flow while delivering all necessary information for a landing page. We curated distinct selling points that showcased the company’s core strengths: Sustainability & Innovation, Off-Grid Expertise, and Leadership. This approach presented a clear and compelling picture of what sets Dragonfly Energy apart. To prominently showcase their battery technology, we developed a mouse-dependent 3D animation using AI-generated images and animation tools, providing an impressive visual experience. We proposed a dynamic “blog” section, titled “Powering the Conversation,” that retrieves content from various relevant resources. Additionally, we introduced the “Energy Savings Calculator Tool”, an interactive web application that enables potential customers to calculate the benefits of switching to Dragonfly Energy’s products. ## Before & After MK-Way. ## You Might Also Like These. ## READY FOR LIFT OFF? Gadimed specializes in offering physician-prescribed weight loss treatments using Semaglutide and Tirzepatide. When David, the doctor behind the brand, and his wife Ruchi approached MK-Way for a website redesign, it was clear that their existing brand identity did not reflect the warmth and personal care their services offered. Their visual identity was overly clinical — evoking a sterile, vaccine-like feeling that did not align with their mission of promoting well-being and a healthier lifestyle. They entrusted us with the critical task of rebranding and redesigning their website to better communicate their values and connect with their audience. ## Making Injections Feel Inviting. The primary challenge was to transform Gadimed's visual identity to make weight loss injections appear friendly and attractive. We needed to convey a sense of well-being, happiness, and longevity through every aspect of the brand — from the logo to the colour palette and messaging — while retaining the medical credibility that a physician-led service demands. ## From Clinical to Compassionate. We started with a deep brand excavation — stakeholder interviews and a comprehensive competitor SWOT analysis. This allowed us to develop a robust brand strategy including buyer persona development, core values, mission and purpose, positioning, USPs, messaging, and tone of voice. Slogans and taglines developed included: "Feel Your Best, Every Day." · "A Journey to a Joyful Life." · "Your Success is Our Joy." · "Preventative Care, Proactive Health." ## Symbolism & Transformation. In an industry saturated with clinical aesthetics, our goal was to create a unique visual identity that conveyed health while standing out. We chose to work with symbolisms that reflected the brand's values — the butterfly for transformation and the cross for health and care. The result is a logotype built on warmth and optimism: a custom wordmark with a distinctive medical cross mark, set in a typeface that feels approachable yet authoritative. ## Trust & Energy in Every Shade. Colour plays a crucial role in shaping perceptions and emotions. We selected a combination of Deep Blue, Medical Blue, and Bubble Blue to evoke feelings of trust, calmness, modernity, and energy — designed to make the audience feel optimistic and reassured. ## One Mark, Infinite Applications. To further enhance Gadimed's brand identity, we utilized the two shapes from the logo symbol to create a versatile pattern. Applied across packaging and marketing materials, this strategic approach created a unified brand experience that stands out and resonates with consumers. ## A Living Brand Across Every Touch. With the core identity locked in, we rolled the brand out across every consumer touchpoint — from product packaging and environmental signage to branded collateral. The butterfly and cross motifs appear consistently, reinforcing recognition wherever a patient encounters Gadimed. ## Where Science Meets Story. We developed two categories of AI-generated imagery: realistic, relatable images of people to visualize weight loss journeys and create emotional connection; and product visuals combining our packaging and label designs with AI to produce compelling, professional product images. Our UX design process began with user research, which informed a sitemap ensuring intuitive navigation. We meticulously crafted the information architecture of all pages, aligning content with the audience's mental models. We implemented a user-centric design philosophy — utilizing the new brand identity and AI-generated imagery to create a responsive, modern, and user-friendly website. Every design decision reflects the brand ethos, ensuring a seamless and engaging user experience. ## The Transformation. ## You Might Also Like These. ## READY FOR LIFT OFF? IATSE 873 is a Toronto-based union representing stage hands and film technicians in Toronto and around Ontario. Members have won or have been nominated for awards such as: Academy Awards, Emmy Awards, Canadian Screen Awards, and many more. They embarked on a project to develop several online courses from various departments for both existing and aspiring technicians. With a focus transferring traditionally taught offline content to an online teaching platform, IATSE 873 recognized they needed help to provide accessible training for all types of members. Our task was to leverage our expertise as designers and e-course development professionals to assist IATSE 873 in the creation of several online courses including (i) Permit Orientation, (ii) Lighting 101, (iii) Respect in The Workplace, (iv) Special FX, (v) Costume Set Supervision and more. Almost every major project comes with bottlenecks. Here’s a few that we encountered: 01. SME and content creation: Our client hired an SME to write the course outline and script. While every e-learning project should have an SME involved in the creation of the course, we should not assume that the SME is also an e-learning creator. This assumption led to project delays and miscommunication within project team members. 02. Feedback mistakes: Managing and presenting detailed information for a vast number of units was a major UX challenge. This required a complete overhaul of the information architecture to create a user-friendly, intuitive navigation system that allowed users to easily access comprehensive details about each unit. We needed to ensure that the vast amount of data was organized in a way that was both accessible and informative, without overwhelming the user. We took charge of the creative direction, developing a unique and visually appealing creative treatment that captured the essence of the subject matter. We designed a distinct branding identity, incorporating IATSE 873 branded blue colours and adding lighter blue tones for a fresh and engaging visual experience. Additionally, we created the course logo, animations, and illustrations, ensuring a cohesive and captivating visual style. With the complexity of the project and the involvement of multiple departments, our dedicated project manager played a crucial role. They took ownership of the entire project, ensuring smooth collaboration between team members and departments. By managing timelines, resources, and communication effectively, the project manager ensured that design work, implementation and quality assurance testing was deployed on time and within budget, maintaining project momentum and quality. We provided guidance and assistance in content creation, working closely with the client to develop the course outline and flow. Additionally, we undertook script creation, transforming real-life examples into educational scripts that were later animated to enhance the learning experience. Through storyboard templates and expert guidance, we supported the development of each scene in terms of content, visuals (video or graphics), and voice-overs. Our expertise in visual storytelling allowed us to create compelling and informative visuals that reinforced key concepts and kept learners engaged throughout the course. To ensure a seamless and professional learning experience, we provided a skilled copywriter who crafted compelling copy for the course materials. Additionally, we created voice-overs where needed, leveraging professional voice talents to deliver clear and engaging narration that enhanced the learning content. Our team excelled in creating captivating graphics, presentation slides, badges, and illustrations that enriched the visual appeal of the course. Furthermore, we developed the logic and graphics for gamification elements, adding interactive and motivational elements to the learning experience. We took on the production and filming of the educational materials in real conditions, ensuring authenticity and relevance to the film technician industry. This approach added an extra layer of practicality and engagement to the courses. We brought the educational content to life through animated real-life scenarios of custom designed characters. These animations min-scenes enhanced engagement and made the learning experience more enjoyable and interactive. We uploaded and built the course in the Tovuti platform, a robust learning management system (LMS). By leveraging the features and functionalities of Tovuti, we created a user-friendly and accessible learning environment for the film technicians. ## You Might Also Like These. ## READY FOR LIFT OFF? The client approached us to create a platform to sell cannabis and psilocybin mushroom products. They pride themselves on high-quality, locally sourced, lab grown ingredients. We were tasked with creating a brand around the concept of “inner” and “outer” space. Inner products are mushroom based and have the effect of hyper-focus. Outer products are cannabis-based and provoke feelings of relaxation and tranquillity. How does one create a platform representing two dimensions of the human experience while building a user-experience-friendly e-commerce website? Having only a logo and a raw concept of inner and outer at hand, our design team embarked on the extraordinary challenge of transforming these initial sparks into a fully-fledged universe of colour, interactivity, and seamless functionality. We collaborated with a local photographer to create captivating images and stop-motion animations, which were used to showcase the products as rotating planets, adding a sense of dynamism to the experience. We developed a distinct colour palette, using deep green/teal tones for the outer experience and purple/pink tones for the inner experience. This visually represented the different dimensions and created a cohesive and engaging visual identity. We developed a splash page that allowed visitors of legal age to choose between the inner and outer navigational experiences of the website. Additionally, we implemented a “sticky” button that followed the visitor, providing easy and seamless navigation between the two dimensions at any point. We implemented interactive animations that followed the mouse movement, combined with floating elements throughout the website. This created a multi-levelled visual experience, allowing visitors to feel a sense of flow and active participation in the trippy journey. We created custom icons and implemented trippy mouse hover effects to elevate the overall experience. By incorporating collage-style black and white images of body parts associated with the human senses for the hover effects, we enhanced the website’s trippy look and feel. We implemented a user-centric design philosophy, utilizing the new brand identity and AI-generated imagery to create a responsive, modern, and user-friendly website. The design reflected the new brand ethos, ensuring a seamless and engaging user experience. We designed a streamlined custom checkout process, incorporating best practices for e-commerce. We implemented adaptive design, optimizing the website for mobile devices. This strategic decision allowed for an exceptional mobile-friendly experience. ## You Might Also Like These. ## READY FOR LIFT OFF? Tell us what's in the way, or get a free look at your website. Mystikó—derived from the Ancient Greek word for 'secret' or 'mystery'—embodies a sense of inner strength, hidden brilliance, and quiet confidence. Rooted in the stories of powerful mythological women and divine symbolism, Mystikó was envisioned as more than a brand; it was to be a modern tribute to timeless feminine energy. When the founder approached MK-Way, the brand was just an idea. We were brought in to build everything from scratch: brand strategy, positioning, buyer personas, messaging, visual identity and packaging. The challenge? Craft a premium, emotionally resonant brand that feels modern and timeless—one that speaks to the senses and stands out in a saturated fine jewelry market. This was not just a design task. It was a full brand birth. ## Two Mountains to Climb. Our two biggest challenges centered around strategic brand positioning and crafting a fully immersive creative universe. The first was developing a unique position in the fine jewelry space. Mystikó needed to speak to a discerning, independent audience and carve out space between traditional luxury and fast-fashion jewelry. We had to identify a positioning that reflected the strength and mindset of modern women: thought leaders who make their own rules, choose consciously, and want their purchasing power to be a force for real change. Mystikó had to go beyond aesthetics and represent a movement—supporting communities once affected by diamond mining while offering ethically sourced, lab-grown brilliance. The second challenge was creative direction. We weren't just building a logo or choosing colors—we were defining the Mystikó world. From movement and model expressions to texture, lighting, tone, and space, we established the sensory language that would make Mystikó unforgettable. Our approach drew heavily from the fashion world, where every detail communicates brand DNA. Most designers stop at the visual identity. We built the feeling. ## How We Built the Mystikó World. We began by laying the foundation through deep audience and market research. We explored lifestyle patterns, luxury values, purchase motivations, and cultural drivers, then used this data to shape our positioning and messaging. We crafted detailed buyer personas and a comprehensive brand framework that included brand story development, messaging, tone of voice, and a clear strategic foundation to guide every creative choice moving forward. At the heart of this work was the Mystikó woman: self-aware, elegant, and intuitive. She is not interested in proving herself, but in honoring herself. She seeks depth over display, presence over perfection. Her choices reflect discernment, and her style is quiet but unforgettable. She is driven by meaning, and expects the brands she supports to carry the same sense of intention and integrity. From this foundation came key taglines and slogans: - Divine by Design - It's a Secret - Diamonds are Forever—Choose them Consciously - Awaken the Goddess in You - You Are the Occasion. All messaging aimed to make women feel powerful and intentional, while maintaining a poetic, editorial voice. Drawing inspiration from high-end fashion houses and artistic movements, we established the Mystikó visual universe—a distinct world defined by ethereal light, warm shadows, close-up textures, contemplative expressions, and quiet strength. We documented every element: how light falls, how a model should look, how fabrics or space should feel, even what emotions to evoke. This approach allowed Mystikó to maintain a cohesive aesthetic even without the logo present—a signature many luxury brands struggle to define. At the heart of the brand sits the Mystikó logo: a minimal, structured monogram that combines three key symbolic elements—the initial "M," the ring, and the diamond shape—each representing strength, unity, and brilliance. Rather than focusing on decorative detail, the logo was designed for meaning, balance, and timelessness. We created a refined color palette to support the brand's story and tone: Mystic Gold to evoke divine energy and understated power, Ivory Veil to convey softness, purity, and warmth, and Deep Obsidian to ground the identity in depth, mystery, and elegance. These hues reflect Mystikó's modern goddess energy—airy, confident, and compelling. We also designed a custom brand pattern using the logo symbol itself—not as an afterthought, but as a deliberate strategic asset. Patterns play a major role in fashion-forward brands, sometimes becoming even more iconic than the logo. For Mystikó, this pattern gives the brand visual continuity across applications like packaging, collection segmentation, digital backgrounds, and more. This wasn't just surface-level decoration—it was an advanced design move that required aesthetic precision and creative foresight. It adds subtle distinction to the brand system and deepens brand recognition through texture, ritual, and form. ## The Unboxing as a Ritual. The packaging experience for Mystikó was designed to reflect the brand's sense of mystery, luxury, and emotional depth. We approached it as a complete unboxing ritual—one that communicates conscious luxury from the first touch. Each element was thoughtfully selected for its aesthetic value as well as how it reinforced the brand's story. From the exterior transport box to the jewelry box and inserts, every layer revealed something new, mirroring the meaning of Mystikó itself—"the secret." We incorporated hidden message details inside the lids and wrapping to surprise and emotionally connect with the customer. A poem from the Greek poet Sappho that represents the Mystikó spirit and brand values, and quiet affirmations were placed intentionally to align with the brand's "secret" nature. Small, luxurious touches made a big difference: shredded branded tissue paper, care guides, custom envelopes, and an eco-conscious care kit added texture and significance to the experience. Our recommendation for fully sustainable materials ensured that the physical presence of the brand matched its ethical values. The result was a memorable unboxing that felt less like packaging and more like a moment—timeless, sacred, and deeply Mystikó. ## Where Technology Meets Vision. To further shape the Mystikó world, we used a blend of AI tools and image editing to generate art direction-ready visuals that expressed the full emotional and aesthetic spectrum of the brand. From glowing product compositions to atmospheric lifestyle shots, we created layered, expressive imagery that could guide campaign development, social content, and product storytelling. These assets played a vital role in showcasing Mystikó's high-concept personality and forward-thinking approach—at once modern, divine, and intentionally styled. ## 20% More for Believe. MK-Way was approached by a surf school seeking to boost leads and bookings through an advertising campaign. Upon evaluating their existing landing page, we identified critical issues with messaging, accessibility, design quality and information architecture. To improve his CRO, we proposed the creation of a new, conversion-optimized landing page. The primary challenge was twofold: Storytelling and Branding / Content Accessibility and Workflows. Our goal was to rectify the existing site’s deficiencies while spotlighting Kala Grace’s impressive surfing credentials. Positioning Kala as a world-class pro surfer was crucial in elevating the school’s reputation and driving increased bookings. In our approach to elevate the website’s user experience, we developed a new sitemap that is more intuitive and aligns seamlessly with visitor expectations. Outdated categories such as ‘Gallery’ and ‘FAQ’ were removed, and page titles were thoughtfully reimagined for clearer navigation. Importantly, we introduced the ‘Kala Grace’ category to accentuate the ‘celebrity’ aspect of the website. At the forefront of the website, we introduced a compelling value proposition, immediately establishing Kala’s prominence in the surfing world. We immersed ourselves in extensive online research. Scouring social media presence, interviews, and brand videos, we carefully collected every valuable piece of content that could elevate Kala’s reputation. Equipped with insights from competitor analysis, we strategized on how to uniquely position him as a legendary surfer. This formed the backbone of our plan to develop his distinct "personal brand" throughout the website. We leveraged Kala’s online presence, including interviews and social media, to craft a narrative in Kala Grace’s unique tone, transforming basic information into an engaging, user-friendly experience. Each service was presented with concise, engaging descriptions, complemented by custom-designed icons that highlighted key information, enhancing the user experience. These sections were meticulously detailed, addressing the informational gaps of the previous site, and presented in an accessible, user-friendly format. To create a truly immersive experience, we strategically incorporated first-person copy in the contact forms, making visitors feel a personal connection with Kala. Additionally, we crafted realistic quotes from Kala, written in his authentic tone of voice, further weaving his brand into the fabric of the website. Selecting and editing images from various sources, we integrated these visuals into the new UI design, amplifying the site’s visual appeal. The introduction of dynamic elements added an extra layer of engagement. Custom icons were created to align with the ‘lessons’ and ‘why us’ sections, adding a unique flair and enhancing the site’s distinctiveness. We incorporated testimonials, videos featuring Kala, and press mentions, serving as key trust factors. This strategic use of social proof translates into increased bookings, as visitors are more inclined to learn from a master surfer whose skills and accomplishments are vividly showcased. ## World-Class Flow. The result was a beautiful, hyper-converting website that truly matched Kala's reputation. Everything from the immersive wave textures to the high-performance UI brought North Shore Oahu Surf School into a Category of One. ## Before & After MK-Way. ## You Might Also Like These. ## READY FOR LIFT OFF? NW Contractors Supply, a leading supplier of waterworks, construction, and industrial equipment, presented us with a challenge: their current Shopify store was disorganized and failed to convey their expertise and trustworthiness. They desired a complete transformation into a functional and converting website that would resonate with their target audience – male independent contractors aged 30-50. The primary goal was to create an intuitive and trustworthy user experience while seamlessly showcasing their extensive range of 15,000 SKUs. Our main challenge was to revamp the website to be user-friendly, convey expertise, and build trust with the target audience. ## Built for Conversion. To capture visitors’ attention instantly, we crafted a strong value proposition, prominently placed above the fold. The message, “YOUR LOCAL ONE-STOP-SHOP FOR WATERWORKS, CONSTRUCTION, AND INDUSTRIAL EQUIPMENT,” conveyed the company’s expertise and trustworthiness immediately upon arrival. We developed an intuitive wireframe, considering best practices for e-commerce and industry standards. The information hierarchy prioritized key sections, enhancing the overall shopping experience. To emphasize unique selling points, we suggested features like “Committed to customer satisfaction,” and “Comprehensive product information & guidance.” We implemented a custom-coded bulk purchase feature under each product, encouraging upselling and additional sales. Furthermore, to facilitate wholesale operations, we streamlined the wholesale process through the “Wholesale Gorilla” Shopify app, offering tailored pricing and discounts for B2B customers. ## Lead Generation & Expertise. To encourage lead generation, we implemented a lead magnet strategy with the “Request Custom Quote” form on the homepage. This allowed visitors to describe their projects, resulting in personalized tool lists and capturing valuable leads. To highlight NW Contractors Supply’s extensive industry expertise, we developed a captivating “Tips and Tricks” blog section, curated with engaging how-to videos and informative articles, enhancing the company’s credibility and boosting SEO. ## Before & After MK-Way. ## You Might Also Like These. ## READY FOR LIFT OFF? Precious Angels Preschool is a childcare and early education center with a strong focus on STEAM (Science, Technology, Engineering, Art, and Math). When co-owners Tammy and Emmy came to MK-Way, they were looking for a website. But as soon as we reviewed their current materials, we knew a new website alone wouldn't solve the bigger problem—their brand identity didn't reflect the high-quality, thoughtful education they offered. We recommended a "mini identity" package that would help reintroduce Precious Angels to the world with a fresh, modern brand that speaks to both children and parents. The goal was to develop an identity that reflects their joyful, science-forward learning environment and pairs beautifully with their new website. ## Playful & Professional. Our main challenge was to create a visual identity that appealed to both kids and parents while also showing the school's commitment to a structured, science-based curriculum. We needed to find a balance between playful and professional—something that would stand out from other preschools while staying true to the unique STEAM approach that makes Precious Angels special. Another challenge was to create something versatile. The identity had to work not just on the website, but across different platforms and materials like signs, brochures, and digital communication with families. ## Building a World of Learning. After our brand strategy call, we created moodboards to explore styles that felt joyful, playful, and educational. We focused on bright primary colors and simple shapes that connect with early childhood education. The client loved the direction, and from there we developed seven different logo concepts. One clear winner emerged. The final logo is made of four main shape characters and a fifth supporting one: - A green square for Science - A red circle for Technology - An orange pentagon for Engineering - A blue ruler for Math - A purple semicircle for Art (used in extended brand elements) Each shape is more than just a symbol—it's a friendly, standalone logo element that can be used throughout the brand. Together, they tell the story of Precious Angels' STEAM-based learning in a way that's simple, fun, and easy to understand for both kids and adults. We created a color-coded system that connects each subject area with its shape. These visual cues make the brand flexible and fun to apply across signage, classroom materials, printed content, and digital experiences. The shapes can live independently or come together as a unified logo, making the system versatile for any use. ## 50+ Visuals. One Consistent World. We developed a set of over 50 playful, AI-generated images that brought the brand to life in a truly creative way. Each image showcased different aspects of the Precious Angels identity—from little scientists and engineers to imaginative classroom scenes. These visuals captured the innovative and STEAM-driven nature of the preschool while also celebrating inclusivity, featuring children of different backgrounds, appearances, and abilities. Designed to align seamlessly with the visual identity, they added warmth, personality, and a sense of wonder to the website and brand communication materials. ## Shapes Come to Life. As a fun, extra layer of expression, we used AI tools to render one of the shape characters in 3D. This creative touch adds dimension and visual interest that can be used selectively in communication materials. ## Built for Busy Parents. Once the identity system was complete, we moved on to designing a website that was clean, simple, and highly user-friendly. We know from experience that parents of infants and toddlers are often overwhelmed when searching for the right school, so our goal was to provide a calm, easy-to-navigate experience that immediately builds trust. We applied the full color-and-shape subject system directly into the website's layout. Each STEAM subject is represented with its dedicated color and icon, which helps parents quickly understand what the school offers and how it aligns with their child's learning journey. The website also integrates the playful AI-generated images in key sections to bring the brand to life visually. Everything—from the copy to the visuals to the layout—was built to reflect the school's unique mix of joy and scientific curiosity. ## The Transformation. ## You Might Also Like These. ## READY FOR LIFT OFF? What to do when your website no longer stimulates business growth? Many companies are focused on providing top-notch service but often fail to show the world what they are made of. In the case of RCAS we were presented with an outdated website that was far from representing their expertise in crisis management and security. Although the company believed they needed a website, they actually needed a complete re-branding that would tell their story and speak credit to their years of experience. We were tasked with creating clarity and showing their potential clients that they were in safe hands. ## Trust & Discretion. The primary challenge for RCAS was not only to redesign their logo but also to comprehensively reposition the brand and develop a compelling narrative that would resonate deeply with their target audience. This involved creating a visual identity and brand story that accurately reflected their values of trust, discretion, and integrity, while also highlighting their extensive experience in crisis management. We needed to ensure that the new branding effectively communicated the essence of RCAS, balancing their rich history with a modern, forward-thinking approach to attract and engage their diverse clientele. ## A Foundation of Trust. We crafted a focused brand strategy for RCAS, rooted in trust, discretion, and integrity. Backed by extensive market research, we developed clear positioning, messaging, and taglines that reinforced RCAS as a credible, network-based authority in crisis management. This approach ensured their identity resonated with their audience while aligning seamlessly with their business goals. We presented several compelling logo options to RCAS so that they could find one they best believed serves their clients. The logo needed to be simple, clear, effective and drive action. Crisis Management and Security is a priority and needs to treated with urgency. The logo we created featuring a path forward with an exclamation mark speaks to that urgency. At the very core of the visual identity, we created a colour palette: red to represent danger and blue to represent security. Bold fonts and attention-grabbing animations drive home important messages and statistics. Supporting graphics and imagery that represent security and strategic development are found throughout the branding. ## Graphic Elements. We created custom icons and implemented dynamic hover effects to elevate the overall experience. By incorporating compelling graphics, we enhanced the website’s professional look and feel, adding an extra layer of visual intrigue to represent security and strategic development. ## Built for Leadership. RCAS now has a client-focused website that is easy to navigate. The website drives action and generates client leads. Governmental bodies, Fortune 500 companies and multi-national organizations can now have confidence that they are working with the world’s best security and crisis management company. The website was created so that it would be easy to manage. No advanced in-house tech personnel is necessary. Restored Timbers, a family-owned business in Long Island, New York, has been crafting handmade reclaimed wood furniture since 1995. They came to us with a problem we see all the time: a website that just wasn't working. The client had been burnt by a previous agency that promised a lot but delivered very little. They felt lost and didn't know what the right move was. Their whole business is built on unlimited customization. They have four unique wood styles—America, Rustic, Farmhouse, and Butterfly—that are available in multiple colors. These can be combined with multiple base styles to create millions of potential table designs. When you add their chair styles and bench options, the number of potential combinations is virtually limitless. This unique offering needed to shine on their website. Moving to Shopify: Contrary to most agencies that recommend the one platform they know how to build, we have no bias when it comes to which platform to use. We just pick the right one for the job. For Restored Timbers, Shopify was the perfect fit. It's a platform built for serious e-commerce, with the tools they needed for custom shipping calculators and 3D product builders. We started with a deep dive into their existing site to figure out what was broken. Our audit revealed four major issues: To fix these issues, we recommended UX research through customer interviews to understand their target audience's real behavior. We conducted our user research in two parts: 1:1 Interviews: We interviewed six people who fit the buyer persona but had never heard of Restored Timbers to get unbiased first impressions. In-Store Survey: We provided a survey for the showroom to understand why people were choosing to shop in person. Our research confirmed the website was cluttered, the navigation was confusing, and users wanted more "About" info. We also discovered that most people add items to their cart and get a second opinion before buying. One major takeaway: users wanted AS MANY customization options as possible. Giving customers control over choices was a major priority. When we showed them a single-page product builder, they loved it. We knew exactly what we needed to build. The solution: a 3D product rendering tool to automatically create every combination on the fly. To pull this off, we had to get creative. We created a roadmap, found specialized photorealistic 3D designers, and selected Zakeke as the fast-loading Shopify 3D configurator app. We also pioneered a new process using AI to create hyper-realistic lifestyle images instead of fake-looking Photoshop jobs. The 3D models were crafted using 3D Studio Max (3ds Max) with real studio lighting. For the AI lifestyle images, we used their new 3D renders with tools like Adobe Firefly and Nano Banana, finishing them in Photoshop. We even used Google Veo3 to animate them. The website design was 100% custom and built with the user in mind. We went through our standard steps: sitemap, wireframes, creative direction, content strategy, copywriting, and UI design. We changed the confusing "collections" terminology and created a new "Signature Wood Tops" section. The biggest challenge was mapping out every possible combination in Zakeke, ensuring the 3D model would update instantly with accurate pricing. The result is a fast, reliable tool that truly shows off what makes Restored Timbers special. ## Before & After ## The Builder Experience ## You Might Also Like These. ## READY FOR LIFT OFF? We have changed the client's name and branding, and present the work here as "Solvia" to protect their confidentiality. The strategy, process, research and creative work shown are all from the actual engagement. ## Reimagining the Learning Experience. Solvia is the name we use here for our client, a long-term care home for the elderly, whose communication needs were as complex as they come. The real issue they brought to us? Their onboarding and training materials weren't working. Internal teams weren't retaining key information. Partners weren't engaging. Most of the content came in the form of long documents and confusing slide decks—hard to follow, not designed for learning, and built as one-off documents instead of part of a larger strategy. There was no structure. No flow. No emotional engagement. We were brought in to solve all of that—and ended up reimagining their entire content experience from the ground up. 01. Starting from Scratch: There was no direction, no framework, no visual system. The materials were a pile of dense content—each document a standalone effort. We needed to create a new structure from zero. Not just a new look, but a strategy for format, tone, information flow, and delivery that could apply across departments and use cases. 02. Finding the Right Tools to Execute the Vision: We had a big creative idea, but no ready-made way to bring it to life. We needed to experiment, prototype, and combine AI and traditional design tools to create something scalable, modern, and engaging. We proposed a complete shift from static decks and documents to short-form training videos, using storytelling methods to engage users and enhance retention. Each video would run under a minute and deliver only the essentials—cutting the fluff, and keeping energy high. We developed two distinct creative paths—one for internal employees and one for external care partners. We also developed our internal SOP to guide our production process, ensuring consistency and efficiency. Our creative direction focused on three types of content within each video: - Presenter/Narrator Avatar: To bring a human feel and added rhythm and engagement to each video. - Animated B-Rolls: These are visual cutaways that demonstrate key points the narrator is describing—whether it's a process, an interaction, or a tool. - Real-Life Animated Scenarios: These are longer scenes that dramatize real training topics. We scripted and animated full moments—how to handle memory loss interactions, how to redirect difficult behavior, how to introduce medication schedules to a family member, and more. They made abstract training ideas tangible and easy to remember. Each of these scenarios was custom-built using characters we created—complete with names, roles, and backstories that reflected the organization’s real team makeup. We created a full character system that mirrored the client's actual audience demographics. These cartoon-style characters included staff members, care providers, and external partners—each designed with diversity, relatability, and real-world roles in mind. They reflected the people actually working at or with Solvia, which helped make the scenarios more believable and emotionally engaging. Every single video was treated like a micro-production: For example, in our memory care lessons, we created two dramatized examples: Scenario 1: "The Year That Was" — A resident named James believes it’s 1985 and he’s late for a job interview. The caregiver, Ava, doesn’t correct him. Instead, she gently engages with the memory and shifts the moment into a walk down the hallway, using validation to preserve dignity and reduce distress. Scenario 2: "Looking for Margaret" — A resident named Nora is looking for her wife who passed away years ago. Instead of telling her the truth outright, the caregiver gently redirects her with warmth and companionship. We scripted these scenes line-by-line, visualized the emotional cues, and animated the full moment—allowing learners to model best practices through clear, realistic examples that reflect their day-to-day work. To ensure consistency across the entire video series, we developed a complete visual system that served as the design template for every single video. This included the style of intros, outros, transitions, typography, color palette, and visual effects. Once approved, this template became the foundation our creative team used for all assets—ensuring that every lesson, no matter the topic or audience, felt like part of the same cohesive system. We created two main production flows depending on the creative treatment: - One focused on AI avatar + animated images, ideal for explainer-style materials. - One focused on AI avatar + real-life animated scenarios, great for training simulations. Each flow followed the same structure with some adjustments: Content breakdown → scriptwriting → storyboard → production → final edit . This made the process replicable and scalable—even for dozens of videos at once. ## You Might Also Like These. ## READY FOR LIFT OFF? Tell us what's in the way, or get a free look at your website. To stand out, we utilized cutting-edge AI tools to create high-quality, original assets. AI Hero Videos: We developed two AI-powered hero videos for the client to choose from, providing a cinematic feel that resonates with the veteran community. Identity Consistency: We used AI to generate several images that maintained a consistent identity across the site. This required adhering to incredibly strict rules regarding Veteran Uniforms and military accuracy to ensure absolute authenticity. ## Conditional Logic Forms. To lower friction and increase lead quality, we developed five complex conditional multi-step forms—one for each service page. These forms guide users through a series of diagnostic questions based on their unique situation, route them toward the specific benefits they are eligible for, and provide a "Free Survivor Assessment" that makes a complex process feel manageable. ## Outclassed & Overlooked. Our initial competitive analysis revealed that UVA was operating at a significant disadvantage. The market was divided into three tiers of service providers, and UVA’s current site was being outclassed in features, trust indicators, and user flow. The primary hurdle was the "Reality Gap": most survivors miss out on benefits because they apply for the wrong programs or believe they are over the income limit. We needed to build a site that immediately bridged this gap, establishing UVA as an empathetic leader with the strategic power of a top-tier law firm. ## Structure, Identity, and Innovation. While the client had an existing visual identity, they lacked a formal Brand Manual. As a core principle of our agency, we believe every client deserves a "North Star" for their visuals. We created a comprehensive Brand Identity One-Pager to serve as their guide, ensuring that every future touchpoint remains consistent and professional. We developed a sophisticated sitemap and content strategy to guide users toward their specific needs. We implemented a "Two Paths" funnel on the homepage, allowing users to choose between "Senior Care & Pension" or "Disability Compensation". We also integrated the proprietary PAVE™ Method (Plan, Advise, Verify, Evidence) to demonstrate exactly how the agency builds a winning claim. ## The Transformation. ## You Might Also Like These. ## READY FOR LIFT OFF? This Privacy Policy describes our collection, use, disclosure, protection, retention and international transfer of personal information, and explains available privacy choices and rights. This Policy covers our business websites, including mk-way.com and proposals.mk-way.com , our electronic proposal and sign-off service, customer communications, and our own customer relationship and marketing activities. It does not replace a separate privacy notice for a product with materially different data practices or a Data Processing Agreement ("DPA") governing personal data we process for a client as a service provider. ## 1. Who We Are and How to Reach Us The organization responsible for personal information collected for its own business purposes is: Mike Kwal Digital Inc. operating as MK-Way 171 Queens Avenue, Unit 501, London, Ontario, Canada Person responsible for privacy: Mike Kwal, CEO Privacy inquiries: privacy@mk-way.com Website: https://mk-way.com MK-Way is ordinarily the organization controlling its own website, sales, proposal, contract, billing and business-contact data. When we handle personal information solely on behalf of a client to deliver that client's website, automation or other contracted service, our role may instead be that of a service provider or processor and the client's privacy notice and applicable DPA may govern that processing. If applicable law requires an EU or UK representative, MK-Way will identify that representative and provide the required contact information in this Policy or an accessible supplementary notice before the relevant processing begins. ## 2. The Information We Collect We collect only information reasonably relevant to the purposes described below, which may include: 2.1 Contact and business identity data. Name, company name, business email, phone number, job title, business address, country, professional role, and information submitted through a form, email, meeting or project inquiry. 2.2 Proposals, contracts and signatures. The signer's typed name, company, position or signing authority if supplied, drawn signature image, initials, acceptance checkboxes, exact accepted agreement and incorporated Terms version, signed-copy or receipt identifiers, payment references, server and device timestamps, IP address, approximate city/country inferred from IP, browser and device metadata, and a document integrity hash or similar verification record. A signature is personal information; a signature image is not automatically treated as biometric-identification data unless actually processed for biometric identification. 2.3 Service and project information. Client instructions, supplied logos and files, website content, documents, feedback, approvals, design and engineering notes, user credentials or access tokens provided for a project, and records of our work and handover. Client-controlled personal data within a project may be covered by a separate DPA. 2.4 Payment and accounting information. Transaction amount, currency, paid/unpaid status, invoice details, billing contact and address, transaction reference, payment method type, masked card information made available by our processor, tax information where required, and refund or dispute information. Card payments are processed by Stripe; we do not ordinarily receive or store full card numbers or security codes in our proposal service. 2.5 Technical and website data. IP address, approximate location, device and browser type, referral source, visited pages, event and error logs, security and fraud-prevention signals, and cookie or similar identifiers where used. Particular analytics and marketing tools depend on current site configuration and your choices. 2.6 Communications and marketing data. Emails, form messages, subscription preferences, consent records, client-support communications, and meeting recordings or transcripts when a recording has been lawfully made with appropriate notice and consent where required. We do not intentionally ask website visitors to supply sensitive personal information unless it is specifically needed for an agreed service with appropriate safeguards. If you send us unnecessary sensitive information, contact us so that we can address it appropriately. ## 3. How We Collect Information We collect information directly from you when you contact us, complete a form, sign a proposal, pay an invoice, submit project materials, or communicate with our team. We also collect limited information automatically from our websites and security systems. We may receive business contact details from an organization you represent, a referral, a public professional source, or an authorized business partner where lawfully permitted. Our providers may return transaction, delivery, security or analytics information needed to operate the services. ## 4. Why We Use Information and Applicable Legal Bases We use personal information for the following purposes, and where EU or UK GDPR applies we rely on the legal bases identified below as appropriate to the person and processing activity: Where consent is the basis for processing, you can withdraw it prospectively through the mechanism supplied or by contacting us. Withdrawal does not invalidate earlier lawful processing. Where legitimate interests are used, we consider the necessity of the activity and the rights of affected individuals, and recognize applicable objection rights. ## 5. Electronic Proposals and Signing Records When you electronically sign or accept a proposal, we create a record intended to show what was presented and accepted, who provided the signature, the date and time, the terms and selections accepted, and the document's integrity. Our system may collect the information described in Section 2.2, including signature image, initials, IP address, device information and approximate location. We use it to administer the agreement, deliver signed copies, deter fraudulent execution, prove contractual acceptance, meet record-keeping obligations and respond to disputes. Proposal pages and sign-off processing use Cloudflare services. Signed files and sign-off metadata are stored in private Cloudflare storage and in Google Drive under restricted business access. An internal Slack notification may contain the signer's name, relevant offer, price, general location and links or references to the record. Stripe handles payment and may receive an associated sign-off receipt identifier to link the accepted proposal to the transaction. A signed-copy link may be accessible to a person who possesses that link. Do not forward it to anyone who should not see the proposal. We aim to use appropriate access restrictions and may revoke or replace links where necessary. A link being excluded from search engines does not, by itself, prevent an unauthorized recipient of the link from accessing the file. If the Client identifies an error in the signed agreement, we preserve the original record and document an amendment rather than altering the executed record without an audit trail. ## 6. How We Share Personal Information We disclose personal information only as reasonably necessary for the purposes described here, as instructed by a client in a processing role, or as required or permitted by law. Recipient categories may include: - Cloudflare: website hosting, proposal/sign-off infrastructure, security and private object storage. - Google Workspace and Google Drive: business email, collaboration and retention of signed agreements and supporting files. - Stripe: payment processing, payment records, refunds, fraud screening and transaction disputes. - Slack: limited internal notifications and business collaboration. - Analytics and advertising providers: Google Analytics, the Meta pixel, Microsoft Clarity, LinkedIn Insight and Microsoft Bing, on mk-way.com only, used under applicable consent and privacy rules. - Other delivery providers: authorized staff, independent contractors, cloud or AI providers, hosting platforms, financial advisers, professional counsel and other service providers reasonably involved in the contracted work, under suitable access and confidentiality arrangements. We do not sell personal information for money. Certain advertising disclosures may be treated as a "sale" or "sharing" under particular US state privacy laws even without payment; where such laws apply, we provide the legally required notices, options and rights. We may disclose information to comply with valid legal process, protect our rights, investigate suspected fraud or safety incidents, and in connection with a legitimate business reorganization or acquisition subject to applicable law. We do not provide mobile-message opt-in or consent records to third parties for those third parties' own promotional campaigns. ## 7. Cookies, Analytics and Advertising Cookies and similar technologies can be used to maintain site functionality, understand performance, prevent abuse and, where enabled, measure campaigns or deliver advertising. The following categories may apply: - Necessary technologies: security, load balancing, essential session state, fraud prevention and maintaining choices needed to operate the service. - Analytics technologies: measuring website use and diagnosing experience issues, where enabled. - Advertising and remarketing technologies: helping measure campaigns or tailor ads, where enabled. Where law requires prior consent for nonessential cookies or similar technologies, we will not activate them before obtaining the required consent. Refusing optional cookies will not prevent access to ordinary site content, although certain optional features may work differently. Browser settings may offer additional cookie controls. Browser-level "Do Not Track" signals do not necessarily operate as a universal legally sufficient opt-out, and MK-Way will honor legally required opt-out preference signals where applicable and technically required. Analytics and advertising vendors may separately process information under their own policies. We will maintain and, where required, disclose an up-to-date cookie inventory reflecting tools actually installed on mk-way.com and proposals.mk-way.com. We do not claim that a particular Meta or Google advertising feature is active unless it has been verified. ## 8. Marketing Communications We may send service communications needed to administer a relationship, and marketing messages where permitted by applicable law. Depending on location, requirements may include Canada's CASL, US CAN-SPAM and relevant EU/UK electronic-marketing and privacy rules. Where consent is needed, we will obtain it and retain appropriate evidence. Marketing messages will identify the sender and provide a functioning unsubscribe method where required. Opting out of marketing does not stop necessary contractual, transactional, security or legal notices. ## 9. International Processing and Transfers MK-Way operates in Canada and works with service providers that may process information in Canada, the United States and other countries in which they or their approved subprocessors operate. Data protection laws in those locations may differ from those in your location. Where EU or UK GDPR applies to a restricted international transfer, MK-Way will use an available lawful transfer mechanism, such as an applicable adequacy decision, a relevant Data Privacy Framework certification where valid for the specific recipient and transfer, or suitable standard contractual clauses and supplementary measures where required. Canada's EU adequacy position does not automatically authorize onward transfers by every vendor. We will provide further information about applicable transfer safeguards on request where the law requires. ## 10. Retention and Deletion We retain personal information no longer than necessary for its purposes, taking account of legal accounting requirements, limitation periods, active client obligations, reasonably anticipated disputes, legal holds and security needs. We apply different retention schedules to different record categories rather than keeping all records indefinitely. Deletion from active systems may be followed by later expiry of backup copies under a documented backup cycle, subject to lawful exceptions. We may preserve minimal necessary evidence of a suppression request, fraud investigation or legal claim without using it for incompatible new purposes. ## 11. Information Security and Access We take reasonable organizational and technical steps appropriate to the information held, including limiting staff access, using reputable infrastructure providers, controlling authorized access to client workspaces, and evaluating security issues. No Internet-based service or transmission can be guaranteed completely secure. Please notify us if you believe a signed-copy link, account or shared project credential has been disclosed to the wrong person. We assess and respond to suspected personal-information incidents and provide notifications to clients, affected individuals and authorities when required by applicable law. Our legal duties depend on our role as controller or service provider, the applicable jurisdiction and the nature of the incident. ## 12. Your Rights and Choices Subject to applicable law and exceptions, you may have the right to request access to personal information about you, correct inaccurate information, withdraw consent, object to certain processing, request deletion or restriction, or request portability of certain data. If EU or UK GDPR applies, you may also have rights to object to marketing and certain legitimate-interest processing, and to complain to your supervisory authority. Rights vary by jurisdiction and are not unlimited. To make a request, email privacy@mk-way.com with "Privacy Request" in the subject line. We may verify your identity or authority before disclosing or changing records. We respond within the time required by applicable law and explain any lawful limitation on a request. A request to delete a signed contract will not necessarily require us to erase evidence we must legally retain to establish contractual rights or comply with accounting law. You may withdraw marketing consent by using the unsubscribe link in a message. Where a working cookie-preferences tool is offered, use it to change optional tracking choices. We do not discriminate against people for exercising privacy rights in circumstances where nondiscrimination protections apply. ## 13. Special Notices for Canada, the EEA, UK and United States Canada. MK-Way's commercial data practices are governed by PIPEDA and applicable provincial private-sector privacy requirements where those laws apply. Certain Canadian laws provide rights and obligations concerning access, consent, accountability, privacy-impact assessments, cross-border processing and breach records or notices. You may contact MK-Way or, where appropriate, the Office of the Privacy Commissioner of Canada or a relevant provincial privacy regulator. European Economic Area. Where EU GDPR applies, you may exercise applicable GDPR rights and complain to a supervisory authority in the EEA state of your habitual residence, work or the alleged infringement. Our processing purposes, lawful bases, recipients, retention and transfer information are described above. Whether an Article 27 EU representative must be appointed depends on our activities and relevant exceptions; if required, the representative's contact details will be supplied before relevant processing. United Kingdom. Where UK GDPR applies, corresponding rights and the UK international-transfer rules apply. You may raise a complaint with the Information Commissioner's Office (ICO). UK representative requirements, where applicable, will be met and the contact details supplied. United States. State privacy rights depend on the individual's location, the nature of processing and whether the business meets the statute's applicability thresholds. Where applicable, MK-Way will provide access, deletion, correction, appeal, targeted-advertising opt-out or other required rights. We do not assert that a single state statute applies to every transaction or that all US privacy laws create identical rights. ## 14. Children Our business services and proposal system are intended for adults acting on their own behalf or on behalf of organizations and are not directed to children under 16. We do not knowingly collect personal information from children for independent marketing. If you believe a child supplied information to us improperly, please contact us so we can investigate and take legally appropriate action. ## 15. Links and Third-Party Services Our sites may link to independent websites and services such as Shopify, Stripe or social media platforms. Once you use a separate service in your own capacity, its privacy terms may apply. This Policy does not imply MK-Way controls an independent site's processing. When a provider processes information for MK-Way, our responsibilities under applicable law remain as described above. ## 16. Changes to This Policy We may revise this Policy to reflect changes in our services, legal requirements or verified data practices. We will update the publication date and provide additional notice or seek consent when required by law. Revisions will not retroactively make processing lawful where notice or consent was required at the time of collection. An accessible copy of the then-current Policy will remain available. ## 17. Contact and Complaints Mike Kwal Digital Inc. o/a MK-Way Please contact us first if you would like a copy of information we hold, need help with your privacy choices, or wish to raise a privacy complaint. You may also complain to the privacy regulator with jurisdiction over your concern where applicable. Version 2026.11. Effective October 10, 2026. --- ## Terms of Service | MK-Way URL: https://mk-way.com/terms-of-service/ Summary: MK-Way Terms of Service: how an engagement is formed, scope, bonuses, payment, electronic signatures, intellectual property, warranty, liability and termination. # Terms of Service Version 2026.11 · Effective October 10, 2026 Company: Mike Kwal Digital Inc. operating as MK-Way ("MK-Way", "we", "us", "our") Business address: 171 Queens Avenue, Unit 501, London, Ontario, Canada Contact: mike@mk-way.com Website: https://mk-way.com/terms-of-service/ These Terms govern MK-Way's provision of design, creative, website, e-commerce, automation, consulting and related services, and, where applicable, digital products. They are intended primarily for business customers. Any mandatory protections applicable to an individual consumer remain in force. ## 1. How This Agreement Works 1.1 Contract documents. The agreement for an engagement (the "Agreement") consists of (a) the applicable signed proposal, statement of work ("SOW"), order confirmation or digital product description (each an "Order"), (b) these Terms as identified in that Order or acceptance record, and (c) any expressly incorporated exhibits or data processing agreement ("DPA"). An individually negotiated master services agreement ("MSA") governs instead of these Terms to the extent it expressly says so. A purchase does not automatically create an MSA. 1.2 Contract documents, paid scope and sales offers. If documents conflict, an executed MSA governs first, then a mutually executed SOW or proposal, then these Terms, then other incorporated documents, unless the parties expressly agree otherwise. The accepted Order's paid-scope section identifies the Services being purchased, including deliverables, price, milestones, exclusions, payment schedule and acceptance criteria. A separate Grand Slam Offer (GSO) sales presentation may advertise complimentary BONUSES, but those promotions do not, merely by appearing in marketing materials, become additional paid website deliverables or paid milestone acceptance criteria. A specifically promised BONUS may nonetheless create a separate obligation under its disclosed promotional terms and applicable law. These Terms do not extinguish a definite promotional promise or mandatory rights. A privacy notice does not alter contractual responsibilities. 1.3 Electronic acceptance. For an Order containing MK-Way's electronic signature process, the Client accepts the Order when its authorized representative completes all required signature and Terms-acceptance steps and the system records completion. For a checkout without an electronic-signature process, the Client submits an offer by affirmatively accepting these Terms and completing checkout, and the Agreement is formed when MK-Way confirms the order or accepts the payment. For a separately signed MSA/SOW, the Agreement is formed as specified in that document. MK-Way may decline an order before acceptance. 1.4 Payment and commencement. Contract formation and authorization to begin Services are different events. Unless the applicable Order says otherwise, MK-Way need not schedule or begin Services until the required payment has cleared and the Client has supplied essential materials and access. No future payment, by itself, changes an already accepted Terms version or proves acceptance of past deliverables. 1.5 Applicable version and changes. The version incorporated and made available at the time of acceptance governs that engagement, unless both parties subsequently agree to an amendment. Updated website Terms apply prospectively to new Orders and do not silently modify existing fixed-fee engagements. A renewal or new SOW may expressly adopt updated Terms. MK-Way will retain a copy of the applicable version. 1.6 Business authority. A person accepting an Order for an organization represents that they are authorized to bind it, and must identify the Client's correct legal name. The contracting Client is the legal person named in the accepted Order, not automatically the individual signer. ## 2. Services and Scope 2.1 Services. MK-Way provides brand strategy, design, visual identity, website UX/UI design, website development, Shopify and other e-commerce builds, AI-enhanced creative services, copywriting, digital collateral, technical support, automation, and related consulting. Only work expressly identified in the accepted Order is included. 2.2 Defined scope. The Order identifies material deliverables, quantities, platforms, dependencies, dates or estimated schedules, included revisions, fees and exclusions. References to examples, demonstrations, illustrations, or projected business outcomes are not additional deliverables unless expressly included. No new work or fee is authorized without written agreement of the parties. 2.3 Service distinctions. "Website Design" means research, UX/UI design, wireframes and visual prototypes, not development unless expressly included. "Website Development" means building approved functionality on the specified platform. "Website Migration" means transferring an agreed site to its destination domain, including agreed DNS/SSL tasks; it does not automatically include legacy databases, blogs, old content, third-party licences or full content migration. "Content Migration" is included only if stated in the Order. 2.4 Client dependencies. Delivery schedules depend on timely receipt of Client materials, decisions, approvals, credentials and third-party services. Unless expressly guaranteed in writing, dates are good-faith estimates that may move for causes outside MK-Way's reasonable control, with prompt written notice. An expressly stated service guarantee governs its covered outcome and remedies. 2.5 Independent scopes. Where an Order or MSA specifies multiple separately described SOWs or milestones, each has its own stated deliverables and acceptance criteria. A deficiency in one scope does not automatically establish a deficiency in independently conforming work under another scope; statutory and payment-network rights remain unaffected. 2.6 External platforms. Shopify, WordPress, hosting services, themes, applications, APIs, payment providers, domains, stock assets and other third-party services are subject to their own licences, terms, fees and availability. MK-Way does not control third-party availability or policies. Additional platform fees must be disclosed in the Order or separately authorized by the Client. ## 2A. BONUSES and Complimentary Gifts 2A.1 Distinction from the paid project. MK-Way may use specific, valuable BONUSES to promote its Services. The accepted proposal or SOW describes the purchased core Services. A BONUS is a complimentary promotional benefit supplied without an additional charge and is not assigned a separate portion of the core project price. Unless expressly incorporated into the paid scope, a BONUS is not a paid project deliverable, project milestone, or condition of acceptance of the paid Services. The promotional offer and the paid project scope should be presented separately and consistently. 2A.2 Defined BONUS fulfillment. A promotional BONUS may provide a defined resource, toolkit, training access, licensed asset library, or other benefit made available on the timetable and conditions stated in the promotion. MK-Way may define access duration, applicable licences, eligibility and reasonable use limitations at the time of the offer. A complimentary benefit is not an open-ended obligation to undertake new custom work, revisions, ongoing support, or content creation unless MK-Way expressly promises those services. 2A.3 Accuracy of specific promises. The name BONUS, the absence of a separate charge, and the omission of a benefit from the signed paid SOW do not by themselves negate a definite promotional promise or permit misleading advertising. If a promotion states that a client will receive a specified number of assets or a defined service, MK-Way will honor that commitment and its clear conditions or amend the promotion before acceptance. Quantity limits, delivery timing, stock-asset licensing terms and other material conditions must be accurately and conspicuously disclosed before purchase. 2A.4 Separate assessment of paid Services. Delivery and acceptance of the purchased website or other paid Services are assessed under the scope and acceptance criteria in the accepted Order, independently of BONUS fulfillment. A BONUS not yet delivered does not, solely by reason of its absence, mean that an otherwise conforming paid website has not been completed, and does not itself reopen an accepted paid milestone. This does not exclude any separate remedy for a binding promotional commitment, misleading representation, or any right that cannot lawfully be waived. 2A.5 Price, claims and records. A complimentary BONUS has no separately invoiced price or allocation of the core project fee and is not independently redeemable for cash unless expressly agreed or required by law. Any advertised estimated dollar value must be reasonable, supportable and not misleading. MK-Way may record separate delivery or access confirmation for BONUSES, without treating such confirmation as paid-project acceptance. 2A.6 Existing warranty is not an added paid-value benefit. Every eligible custom website or application launch already includes the standard 30-day technical warranty in Section 11.2. MK-Way may highlight that existing protection in its GSO with the marketing headline "BONUS: 30-Day Bug-Free Guarantee," provided the accompanying explanation accurately states that it means correction of covered defects under Section 11.2, not a promise of literally zero bugs, unlimited new development, or guaranteed same-day resolution. The existing warranty must not be presented as an additional paid service or assigned an unsupported incremental bonus value. ## 3. AI-Enhanced Delivery 3.1 Proprietary AI-enhanced process. MK-Way employs proprietary AI-enhanced workflows as part of its creative process. AI workflows enable faster turnaround, broader creative exploration, and deliverables that reflect capabilities typically associated with larger teams. Subject to expressly agreed specifications and applicable law, MK-Way determines its internal methods, staffing, tools and production workflow. 3.2 Human review and AI limitations. All AI-assisted work delivered to the Client is reviewed, refined and approved by MK-Way before delivery. AI is an internal efficiency, never a substitute for professional judgment. MK-Way does not guarantee that AI-generated material is unique, error-free, registrable or protectable by copyright, or that unverified third-party claims are accurate. 3.3 Value of efficiency. Efficiency gained through AI workflows is a proprietary benefit of MK-Way and does not reduce the agreed project fee. 3.4 Data safeguards. MK-Way will not knowingly input Client confidential information or personal data into an external AI service contrary to applicable confidentiality obligations, the Privacy Policy, any DPA, or agreed written restrictions. Any Client requirement for a specific model, data location or prohibition on AI use must be documented before work begins and may affect price or schedule. ## 4. Client Responsibilities, Delivery and Acceptance 4.1 Authorized contact. The Client designates one responsible decision-maker ("SPOC") to coordinate information and deliver approvals. The Client may change its SPOC by written notice. 4.2 Materials and rights. The Client supplies correct content, lawful instructions, required approvals, access and assets reasonably needed for the Services. The Client represents that it owns or has permission to use materials supplied to MK-Way and will promptly notify MK-Way of inaccuracies or restrictions. 4.3 Delivery for review. MK-Way may submit identified deliverables or milestones through email, a staging environment, file link or agreed project platform. A delivery notice will identify what is ready, where it can be inspected, applicable acceptance criteria, and the response deadline. Launch or publication is separate from staging review where the Order so specifies. 4.4 Review period and scope tested. Unless an Order states another period, the Client has five business days after an accessible, identifiable delivery notice to provide written acceptance or a reasonably specific written list of material deficiencies against the agreed paid scope. Promotional BONUSES outside the paid scope do not create additional website acceptance criteria. A preference change or request for additional features is not by itself a failure to meet agreed scope. 4.5 Deemed acceptance. If the Client does not respond, MK-Way may issue one reminder identifying the paid deliverable and allowing at least three additional business days to respond. Absent a reasonably specific notice of a material deficiency in that deliverable within the extended period, it will be considered accepted for ordinary contractual milestone purposes to the extent permitted by law. The absence of a separately advertised BONUS does not alone prevent acceptance of a conforming paid deliverable. Deemed acceptance does not waive concealed defects, fraud, claims concerning independently enforceable BONUS promises, or other non-waivable rights, and does not establish that undelivered paid work was performed. 4.6 Remediation. If a timely report identifies a material nonconformity, MK-Way will have a reasonable opportunity to correct it and resubmit the affected deliverable. Acceptance of unaffected milestones remains in place. The Client must reasonably cooperate in verifying corrections. 4.7 Delays and inactivity. MK-Way may adjust schedules where Client feedback, materials or approvals are delayed. After ten business days of Client-caused delay, MK-Way may propose a documented rescheduling or reactivation fee proportionate to actual effects, but no new fee applies without its contractual authorization or the Client's agreement. After twenty-one consecutive calendar days of material inactivity, MK-Way may deliver a written seven-day cure notice and, if unanswered, pause or terminate under Section 13. No automatic forfeiture applies merely because time passes. ## 5. Revisions and Changes 5.1 Included revisions. Unless otherwise specified in the Order, custom creative deliverables include two rounds of within-scope revisions per deliverable. A revision round means one consolidated, written list of changes received from the authorized contact. Productized digital items and ongoing retainers follow their stated product or service conditions. 5.2 Extra rounds. Additional requested rounds are priced at USD $495 per round unless the Order states another rate. MK-Way will identify the charge and secure written authorization before proceeding. Material new functionality, additional pages, new creative directions and out-of-scope services require a separate quote or change order. 5.3 MK-Way correction. Corrections required because MK-Way failed to satisfy an express specification or made an error within its contracted responsibility are not charged as discretionary revisions. ## 6. Payment, Taxes and Refunds 6.1 Fees and currency. Fees, milestones and due dates are those in the accepted Order. Unless stated otherwise, fees are in US dollars. The Client bears any applicable bank conversion charges. Applicable taxes are added or handled as required by law; a particular VAT/GST/HST treatment is not promised unless shown on the invoice. 6.2 Payment methods. Available payment options may include card through Stripe and bank transfer, ACH, EFT or Interac e-Transfer. Any payment-method discount must be clearly disclosed before acceptance and comply with applicable law and network rules. Except where law requires otherwise, MK-Way does not store full payment-card numbers. 6.3 Invoicing and late payments. Invoices are due on receipt unless the Order states otherwise. Invoices unpaid after thirty (30) days accrue simple interest at 1.5% per month (18% per annum), calculated on the overdue balance, or the maximum lawful rate if lower. If an invoice is more than ten business days past due, MK-Way may, after written notice and a reasonable opportunity to correct an administrative error, pause future undelivered work until payment clears. Paused projects resume subject to availability, and affected completion dates move accordingly. A bona fide dispute over part of an invoice does not excuse timely payment of undisputed amounts. Additional dispute remedies are governed by Sections 7 and 13. 6.4 Fixed-fee project commitments and earned fees. The accepted fixed project price reflects the agreed Services and MK-Way's commitment of time and production resources. Payment in advance does not, by itself, prove that all work has been performed. Fees are earned through performance of contracted work, documented deliverables or milestones, and separately disclosed, reasonable reservation or discovery commitments. The absence of hourly billing does not convert a fixed-fee Order into time-and-materials billing. Where an Order allocates prices among deliverables, that allocation guides accounting for completed work and lawful termination remedies. Deposits are credited toward the agreed project price unless a separately defined reservation fee is expressly identified. 6.5 Cancellation, prepayments and adjustments. Fixed-fee custom projects are not cancellable for convenience unless the accepted Order expressly grants that right or applicable law requires otherwise. A Client's unilateral instruction to stop work, failure to cooperate, or repudiation does not itself extinguish the obligation to pay sums properly owing or damages lawfully recoverable, subject to MK-Way's duty to mitigate loss. Following a lawful termination or written cancellation agreement, MK-Way may retain earned fees, agreed enforceable reservation charges, approved non-cancellable third-party commitments and other demonstrable amounts lawfully recoverable under Section 13. Excess prepayments will be returned where required by law or the agreed settlement. Neither an automatic forfeiture of every prepayment nor an automatic return of every unperformed portion is intended. 6.6 Digital products. A productized digital offer, including Brand Codex, carries the cancellation, return or satisfaction guarantee, if any, expressly displayed on its product page at the time of purchase, together with any non-waivable statutory rights. These Terms do not independently create a 30-day money-back guarantee unless the applicable accepted product offer expressly provides one. 6.7 Collections. MK-Way may recover reasonable, documented collection costs and fees to the extent awarded, contractually recoverable and lawful. A disputed sum is not automatically owed twice merely because a reversal or chargeback is initiated. Disputes are governed by Section 7. 6.8 Hosting. Hosting, including EmpathyHost where offered, is subject to any separate hosting terms, service period and pricing expressly disclosed before purchase. Unless otherwise agreed, hosting fees are charged in USD and are distinct from a custom-project build fee. ## 6A. Electronic Signatures and Contract Records 6A.1 Consent. Both parties consent to the use of electronic documents, electronic signatures, electronic notices and electronic records for ordinary commercial agreements, approvals and communications, except where applicable law requires a different form. 6A.2 Acceptance method. An authorized representative's typed name, drawn signature, initials and affirmative checkbox selection may together demonstrate the person's intent to accept an Order when required by the sign-off interface. The parties agree not to contest enforceability solely because an agreement is electronic. This does not claim that every signature type automatically meets the formal requirements applicable to every document or jurisdiction. 6A.3 Record. MK-Way may preserve the exact accepted proposal, applicable Terms version, signer's provided information, initials, signature image, acceptance controls, timestamps, IP address, approximate location and device or browser details, together with document integrity identifiers and transaction references. Such records may be produced as evidence of acceptance, performance or a payment dispute, subject to applicable evidentiary rules and the Privacy Policy. 6A.4 Copies and correction. MK-Way will provide the Client with a retrievable copy of the executed Order electronically or a controlled access link. The Client must promptly advise MK-Way of an incorrect legal entity, unauthorized signature or record discrepancy. The parties may correct clerical errors by a recorded amendment, without silently altering the original signed record. ## 7. Billing Concerns, Payment Disputes and Chargebacks 7.1 Direct resolution. The Client is encouraged to contact MK-Way at mike@mk-way.com promptly about an inaccurate charge or alleged delivery deficiency, with reasonable supporting detail. MK-Way will investigate and attempt a good-faith resolution. A direct complaint is not required where applicable law or network rules permit or require the Client to take other action. 7.2 Payment-network rights and genuine disputes. Nothing in these Terms prevents the exercise of a lawful card-network dispute, chargeback, bank complaint, regulatory complaint or other non-waivable remedy. Initiating a good-faith dispute does not, by itself, constitute fraud or material breach. However, the initiation or resolution of a payment-network dispute does not by itself establish that MK-Way failed to perform its contractual obligations or extinguish any separate amount lawfully owing. Knowingly false material representations or a failure to pay amounts lawfully due may give rise to contractual remedies subject to applicable law. 7.3 MK-Way's evidence and enforcement rights. MK-Way may submit the signed Order and applicable Terms version, invoices, transaction records, scope, evidence of delivery, milestone acceptances, written correspondence and other relevant proof in a card dispute, and may pursue amounts and demonstrable damages properly due under the Agreement and applicable law. Where undisputed amounts are overdue, an unauthorized reversal creates nonpayment, or an independently established material breach remains uncured, MK-Way may suspend future undelivered work on reasonable written notice, subject to mandatory law and any express continuity obligations. MK-Way will not interfere with Client-owned property or fully paid rights contrary to law or express agreement. 7.4 Fees and reversals. Reasonable chargeback or collection costs may be claimed only to the extent lawfully recoverable and not already reimbursed. Any refunded, reversed or recovered amount will be accounted for so neither party receives a double recovery. ## 8. Intellectual Property and Licences 8.1 Client materials. The Client retains rights in its pre-existing materials and grants MK-Way a limited licence to use them as necessary to deliver the Services. 8.2 Final original deliverables. Subject to full payment of the amounts allocated to the relevant deliverables, MK-Way assigns to the Client the intellectual property rights that MK-Way owns and is legally able to assign in the final, specifically identified original deliverables, excluding retained elements and third-party materials under this Section. The assignment does not promise exclusive ownership of output for which exclusive intellectual property rights do not legally arise. 8.3 MK-Way retained materials. MK-Way retains its pre-existing and independently developed methods, templates, frameworks, know-how, reusable code libraries, tools, prompts and workflows ("MK-Way Materials"). To the extent embedded in a paid deliverable and necessary for its intended use, MK-Way grants the Client a worldwide, perpetual, non-exclusive, non-transferable except with that deliverable, royalty-free licence to use such materials as incorporated in that deliverable, subject to valid third-party licence limits. This is not a general licence to extract or resell MK-Way's standalone tools. 8.4 Third-party and AI materials. Stock content, fonts, plugins, themes, software, open-source components, APIs and other third-party materials remain governed by their respective licences. The Client receives only the rights lawfully available under those licences. AI-assisted materials may involve legal uncertainty concerning originality, exclusive rights or registration; MK-Way transfers only rights it possesses. Relevant third-party restrictions known to MK-Way will be disclosed in the delivery documentation or Order. 8.5 Work in progress. Until agreed fees for particular work are paid, the Client may review draft materials solely to evaluate them and may not deploy, commercially exploit or redistribute unpaid deliverables without written consent. Any suspension or withholding is subject to applicable law and cannot revoke rights already irrevocably transferred in fully paid, separable deliverables. 8.6 Portfolio. MK-Way may publicly identify the Client and display publicly launched work in its portfolio unless the Order or a written confidentiality undertaking states otherwise. Unreleased, personal, confidential or commercially sensitive information may not be disclosed for marketing without appropriate authorization. ## 9. Communication and Recordings 9.1 Channels. The parties will use the agreed client contact, project platform, email or Slack channel. MK-Way's normal business availability is stated in its onboarding materials; any response-time guarantee must be expressly set out in the Order. 9.2 Notices. Ordinary project approvals may be given through the agreed authenticated project channel or email. Formal termination, material breach and dispute notices must comply with Section 15. 9.3 Meetings and recordings. MK-Way may propose recording project meetings to create accurate notes and deliver work. MK-Way will provide appropriate notice and obtain consent where legally required, and will respect a reasonable request not to record where recording is not essential to an agreed service. Recordings are handled under the Privacy Policy and any DPA. ## 10. Confidentiality, Data Protection and Security 10.1 Confidential information. Each party will use the other's nonpublic commercially sensitive information only to perform or administer the Agreement, restrict access to personnel and providers with a need to know, and protect it using reasonable safeguards. This does not apply to information lawfully public, independently developed without use of confidential material, lawfully received from another source without restriction, or required to be disclosed by law after permitted notice. 10.2 Survival. Confidentiality obligations continue for three years after termination, and for trade secrets for as long as the information remains a trade secret under applicable law. More protective written obligations control if expressly agreed. 10.3 Personal information. MK-Way processes its own business-contact and signing information as described in its Privacy Policy. Where MK-Way handles personal data on the Client's behalf, the parties will implement a DPA where legally required, specifying purposes, security, subprocessors, transfers, assistance, incident reporting and deletion/return requirements. 10.4 Providers and AI. MK-Way may use vetted cloud, communication, payment, design and AI service providers as appropriate to the engagement. The parties may agree to restrictions on specific providers, categories of confidential data and processing locations before work begins. Third-party providers do not relieve MK-Way of contractual duties it has undertaken. 10.5 Security incidents. MK-Way will maintain reasonable safeguards appropriate to the information and Services involved. On learning of a confirmed personal-data breach affecting information it processes for the Client, MK-Way will notify the Client without undue delay and provide reasonably available details to support legally required assessment and notifications. Notifications to individuals and authorities follow applicable law and the parties' respective responsibilities; no uniform 72-hour contractual promise is implied. ## 11. Warranty, Remedies and Liability 11.1 Standard of performance. MK-Way will provide Services with reasonable professional care consistent with the agreed scope. Subjective preferences do not override objective written specifications, but written specifications and express promises remain binding. 11.2 Thirty-day technical warranty. For a custom website or application launch, MK-Way provides a 30-day period after production launch during which it will correct reproducible technical defects caused by MK-Way's work that materially depart from agreed specifications, provided the Client reports the issue and gives reasonable diagnostic access. MK-Way ordinarily aims to acknowledge and triage covered reports during the next business day and to resolve straightforward defects the same business day or within approximately one business day when feasible. These are good-faith service targets, not a guaranteed same-day or 24-hour repair deadline. Weekends and Ontario statutory holidays are excluded from business-day targets. Larger or more complex fixes will be handled within a reasonable time, with status information provided to the Client. This warranty does not promise that the website will literally contain no bugs. It does not cover new features, discretionary content changes, routine maintenance, third-party outages or problems actually caused by unauthorized later changes. Unrelated third-party changes do not void coverage for an independent defect. The warranty is part of the paid Services, not an additional paid-value BONUS. 11.3 Cure. Except where urgent relief is necessary, a party asserting material breach will provide written details and a reasonable opportunity to correct the issue, ordinarily thirty days after notice where correction is reasonably possible. This requirement does not waive mandatory statutory rights or payment-network procedures. 11.4 Excluded damages. To the extent permitted by law, neither party is liable for indirect, special or consequential losses, including lost anticipated profit or business opportunity, except to the extent a particular category of loss is expressly included in an agreed remedy or cannot lawfully be excluded. 11.5 Liability cap. Subject to Section 11.6 and applicable law, each party's aggregate contractual liability arising from a specific Order is limited to the fees paid or payable under that Order. Separate Orders are not automatically aggregated. Any agreed DPA or MSA may provide different limits. 11.6 Exceptions. Nothing excludes or limits liability for fraud, intentional misconduct, amounts lawfully due as fees, or liability that cannot legally be limited. 11.7 Third-party upkeep. Unless the Order includes a support plan, the Client is responsible for third-party subscriptions, licences, platform renewals and ongoing maintenance following handover. Any explicit 90-day transitional licence support obligation in an accepted Order remains enforceable. ## 12. Indemnification 12.1 Client indemnity. The Client will defend and indemnify MK-Way against third-party claims to the extent resulting from materials the Client supplied without sufficient rights, the Client's unlawful products or instructions, or its misuse of deliverables beyond agreed permissions, except to the extent caused by MK-Way's breach or negligence. 12.2 MK-Way indemnity. MK-Way will defend and indemnify the Client against third-party claims that original deliverables created by MK-Way for the Client infringe an enforceable third-party intellectual property right, excluding Client materials, third-party components used under their licences, modifications by others and combinations not specified in the Order, and subject to available legal defences. 12.3 Claim process. The indemnified party must notify the indemnifying party reasonably promptly, give reasonable cooperation, and permit the indemnifying party to manage the defence, provided no settlement imposes an admission, ongoing obligation or nonmonetary restriction on the indemnified party without consent. Liability limitations in Section 11 apply except where prohibited by law or expressly overridden in an Order. ## 13. Suspension and Termination 13.1 Convenience termination and fixed-fee commitments. An ongoing monthly retainer may be terminated by either party on thirty (30) days' written notice, unless its Order specifies another minimum commitment or notice period. A fixed-fee custom project is a binding project commitment: neither party has an automatic right to terminate it for convenience unless that right is expressly stated in the accepted Order or required by applicable law. The parties may agree in writing on an early exit and settlement. A unilateral request to stop or abandon work does not itself waive sums lawfully due, but MK-Way must take reasonable steps to mitigate recoverable losses. 13.2 Termination for cause. Either party may terminate for a material breach not cured within thirty days of detailed written notice, or sooner if the breach is incapable of cure or if fraud or unlawful conduct justifies immediate termination. An insolvency-related termination is subject to applicable insolvency law. 13.3 Settlement, losses and mitigation. Upon termination permitted by the Agreement or applicable law, or following a Client's repudiation or a mutually agreed early exit, MK-Way will prepare a reasonable written accounting of completed and in-progress Services, milestone or deliverable price allocations where stated, approved non-cancellable commitments, prepayments and recoverable losses caused by breach. To the extent permitted by law, recoverable damages may include reasonably foreseeable lost net profit on the unperformed portion, subject to the duty to mitigate and crediting costs avoided; no damages are presumed solely because a project was cancelled. The Client remains responsible for amounts lawfully due, but MK-Way will credit sums already paid or recovered and will not collect twice for the same loss. Any balance that must be returned under applicable law or a written settlement will be returned. Fixed-fee work is not retroactively converted to hourly billing. 13.4 Handover and continuity. Subject to payment of undisputed amounts properly due, MK-Way will make available completed, paid-for deliverables and Client-owned materials in MK-Way's control, in the form and within the timeline agreed in the Order or a reasonable handover period. Existing legally granted licences are not retroactively revoked merely because future work is suspended. 13.5 Non-solicitation. During the engagement and for twelve months after it ends, the Client will not knowingly solicit for employment or direct engagement an MK-Way employee or contractor materially involved in the engagement without MK-Way's written consent, excluding general public advertisements and unsolicited approaches, to the extent enforceable under applicable law. No restriction overrides a mandatory employment or competition rule. ## 14. Dispute Resolution 14.1 Good-faith discussion. A party with a contractual dispute should give written notice describing the issue. Designated representatives will attempt in good faith to resolve it for up to fifteen business days. 14.2 Mediation. If unresolved, the parties will attempt nonbinding mediation with a mutually agreed mediator, provided mediation can be arranged within thirty days. If no mediator is agreed or the mediation does not resolve the matter, either party may proceed to court. Neither party is required to miss a statutory filing deadline or forgo urgent injunctive relief. 14.3 Courts. Subject to mandatory law, the courts of Ontario sitting in London, Ontario, have exclusive jurisdiction for disputes concerning these Terms. This forum selection does not override a Client's rights that applicable law prohibits the parties from waiving. 14.4 Card and regulatory processes. Contractual negotiation or mediation does not extend deadlines or bar payment-network, regulator or statutory processes that cannot lawfully be waived. ## 15. General Provisions 15.1 Governing law. Ontario law and applicable federal Canadian law govern, excluding conflict-of-laws principles, subject to non-waivable protections under applicable law. 15.2 Entire agreement. The Agreement described in Section 1 supersedes prior proposals and representations about that engagement except for fraud or express terms incorporated into the accepted Order. Each separate Order may be a separate engagement. 15.3 Amendments. A material amendment, change order or waiver must be in writing, including a verifiable electronic record accepted by authorized representatives. Routine project communications do not automatically change commercial terms. 15.4 Severability and waiver. An invalid term will be limited or severed to the minimum extent needed without invalidating the remainder, where permitted. Failure to enforce a right once does not waive it later. 15.5 Assignment and subcontracting. Neither party may assign the Agreement without written consent, not unreasonably withheld, except as part of a genuine merger, reorganization or sale of substantially all business assets with adequate continuity of obligations. MK-Way may use responsible subcontractors subject to the Agreement's confidentiality and data-protection commitments. 15.6 Force majeure. Neither party is liable for delay caused by events beyond its reasonable control despite reasonable mitigation, excluding amounts already properly due. The affected party will promptly notify the other and resume when feasible. Either party may terminate an affected Order if the event materially prevents performance for eight consecutive weeks, with settlement under Section 13. 15.7 Independent contractor. MK-Way is an independent contractor and not the Client's employee, partner, fiduciary or joint venturer, except where a specific law or signed agreement creates a separate duty. 15.8 Notices. Formal breach, dispute and termination notices must be sent to the business contact email specified in the accepted Order, with a copy to mike@mk-way.com for notices to MK-Way. Notice is effective when reasonably evidenced as delivered to the designated address and not returned as undeliverable. Either party may update its notice details in writing. 15.9 Language and interpretation. The parties have selected English as the working language for the Agreement to the extent permitted by applicable law. Mandatory local language rights, including where applicable in Quebec or other jurisdictions, remain unaffected. Headings are for convenience only. "Including" means "including without limitation" unless context clearly requires otherwise. 15.10 Contact.
